The lease due on the 1st but we give 2 more days forgiveness so that will be the 3rd. This tenant was only paid on time for 2 times on the 1st then started paying on the 3rd and then dragging longer (6 month total period). The court dismissed the case and we responsible all the fees. The judge didn't look other violations that listed on the form other than being late pay. The judge even didn't give chance for my husband to explain the case. We think maybe we are better hire the professional that more knowledge and experience about the procedure. Also this tenant has been warned twice by the city because he violate zoning residential by he parked his car on the lawn. And our lawn has sprinkle system installed even though most tenant never use it. 

The judge dismissed our eviction filing because the tenant has paid the rent even though he paid on 23rd. thats why i said no..no, never take the payment during the court filing. 

Sorry i was missing the word "date", we took the payment during the process of filing before the court date.  Sorry for the confusion.  I just talked to this company and told them the situation, they looked up who in charge in my property court district area (Tarrant county). They said, its been known this judge is pro Tenant. I said so basically the judge won't look at the case for late payment unless its 2-3 months back rent.  So its okay for paying late rent because they are paying rent, thats suck! what kind the business we are running if we can't even demand payment one time.   

We may called New Investor, haven't experienced court filing and all that procedure. First eviction filing on our own without success because we took the payment before the court which is no..no, okay we learn that won't happen again. But this Tenant keep doing back rent, we couldn't put up with it anymore as he hasn't paid this month rent till now. Anyone heard about the company called FRONTIER EVICTIONS ? in Dallas, If any of you have ever use their service, do you mind to share how well they did?. They are not Attorney but they are specialize firm to do eviction for Landlords and they charge flat fee. Thank you very much in advance.

Thank you for your help. You will be surprise next time you visit to Burleson, we moved to Burleson in 2008 and it has growing fast. Here is our case i want to share ; We have tenant that been late paying within 6 months and including this month and still unpaid. We haven't experienced with this issue before so we lost our first the eviction filing last January, because we took his payment on 23rd before the court date on Feb 3rd. He has other violations beside the paying late. If we file again and not taking the money, are we definitely will win ? Also if the contract signed by the daughter of his and he is not on co signed but he listed on the lease as an occupant. The daughter had been moved out since Nov and we has been discussed with him to rewrite the lease but he is never responded. I really want to file against him, he is really bad person. Thank you for share your thought.

Will we win the case if we don't take any payment from them. Is there more reason the court dismiss the case.? My husband afraid we will lose again and let the lawyer handle it.

Thank you for your opinions. The dad listed on the lease agreement but he didn't sign, the daughter did. So right now we even don't know who else living there, his new "wife", son don't know which son, daughter and his grand kids. Yes we did wrong last filing since we aren't experience on this. We heard if you file for multiple person you have to pay more fees because they charge individual that you want to against with.

We have kinda complicated issue with our tenant here, first of all we have the contract signed by the daughter of the father who is the one paying the rent. Because the father has bad credit and want to help her daughter to build her credit. The contract signed in on May 29, 2015and moved in June 15 for 2 years lease. We haven't been any issue with our previous tenants except just property condition issue. In December we found out the daughter had been moved out in November. The father has started paying late since October, first paid to 5th, 7th (2x), 15th, 23rd, 15th. Last February we tried to file eviction against the daughter since she is still the primary on the contract. Until now the contract has not been rewrite because his father obviously not interested to rewrite new lease. We lost the eviction file because we accepted the payment on 23rd before the court date. This month we have send him a notice to vacate till the 15th if he is not paying the rent. He told me on cell phone text message he won't be moving till the lease end which is on May, ( he doesn't remember the lease signed for 2 years) and I don't recall it because we looked up the law the contract has been default. And other violations he made, he brought the dogs without paying the dog policy and he lied he said my husband knew and allow it. Then he brought a new wife in last February (we told them to sign a new lease to update list who is living in the property) But he ignored it because we raise the late charges from $35 to $50 and $10 each day after ward. He knew he wants to pay late every months only by paying $35 and he always bringing up his deposit as holding of his payment for being late. And we have explained and he doesn't really care.  He violated zoning city law by parking his car on our yard twice and could possibly broke our lawn sprinkle system. My husband doesn't want to talk to him anymore and fed up, he is afraid to lose in court if filing by himself again. He is ready to to use lawyer this time. My question is do we need to endure till next month filing since today is the 14th and takes 2 weeks and more for procedure. I am trying to find the best way to avoid losing more money. Thank you.
