@Corey Woodruff, I haven't done trying to negotiate with him but he is an**hole, his a liar so i don't think it won't be any good. I thought about it but nah..he is a liar and he won't moved out, all he does will make me more embarrass that he win. 

@Steven Woon This person didn't  care about his credit record because he has already have bad credit in the first place. This person who is living in my house is the secondary of the lease, and the primary sign holder which was the daughter had been move out last year in nov without gave us a report. So We evict both of them, and this case the daughter credit will damage but It doesn't matter for them anyway, they will use their new spouses for getting new application need. The system is broken, Criminal can always getaway from murder.

@Steven Woon Thank you. We did hire the eviction service. hired him on March 17, he filed on March 29 to JP and got the court date april 12. Kinda slow service he gave me i think. But we want to make sure we will do it right since first attempt on our own failed. I know we kinda cross our fingers this person will pay the judgement. I am thinking to report them to credit business bureau for the amount their owe. Have you done that?

Thank you Nicole for the advise, I am trying to stay calm but since i am beginner and only have 3 rental properties. Its gives me nerve break down for losing money. I won't give any break next time for another drama. Once is enough.

@Thomas Bryant Thank you for the information. I wish they are allowing to file eviction and writ possession the same time with short process. Even though they said Texas is the quicker process than other states, but not fast enough. 

@Greg H. Gosh..thats make me agitated, wish you able throw out they belonging since they have been already caused you a damage. Piss me off. Its very unfair ! Did you file claim for the damages? Do you claim legal fees toward the tenant?  I wonder if the court can move my court date faster. Mine March 12th. My tenant have not volunteer to move out, most likely they are not going to. I drove by the other day, went to the back yard (of course no one home), my back door wood trim got damage by his dogs and they didn't pay the dogs fees. (they lied by not having pets). What can the justice do toward this bad people?. If the tenant appeal, can the landlord refuse them?

@Roy  Thats why we hired the eviction service who had done this million times. We are not trying to do waste more time, just the procedure take longer than you do on your own. Just think how much we will lose because this "criminal", and especially for people who know the procedures. Our big mistake we took them in, and we didn't screen all the adult instead one person and the primary signed holder had been moved out. We are small investor, doing it for college fund of my kids or maybe retirement saving. If we are getting out of hand as our investment growing definitely property management will be helpful. 

We decide to wait and follow the procedure. Just have an update, court date on the 12th. Wish me luck!.

First, thank you guys for all response here. Our First experience dealing with deadbeat tenant, this person is a**hole. Had been paying late the last 5 - 6months. I am so angry that i gave him notice to move out and he refused. My husband filed it in January but lost since we didn't do research in the first place after took the money on 23rd. And he didn't want to do it again so we hired someone else but it taking so looong 15-25 days process. I was about to call this service firm up to cancel if they haven't file. I lose my patient over this. I am so ready to move on. 

We are hiring the eviction firm to do eviction filing for us, this tenant hasn't paid us for March rent. And he challenge us to go to court, and we haven't heard the court date yet from the service firm. They said they haven't heard back from the court, and i hired him since the March 16. He said it take 15-25 days for process. I was thinking to drop my emotion and offer him cash. What do i need to say to the tenant? how many days i can give him for moving out?
