Its seems my tenant appeal the case, according the law i read, he has to pay the bond or affidavit inability to pay for 1 month rent. Does the court will accept the appeal ? how does works? I am looking for the lawyer to help my case. I am in tarrant county.

@Bret Allen

Thanks so much for you response, I really appreciate you taking the time.

So the judgement was for a total of $2580.00.  If we offered an written agreement to hold off until May 2 to file a Writ of Possession, on condition that  he pays the Judgement amount to us by Friday April 22.

That would be reasonable. giving him until the end of the month to move out.... and we get our money.

if he chooses not to pay then we execute the writ of possession by Monday April 25th.

@Ahalyaa M. Thank you for the link, i am reading it right now.

@Greg H. Hi Greg, I've appreciate your knowledge. I am quite learning so far from this BP forum. I am trying to understand why my agent trying suggested to work with him. I want to make sure i am following the procedure and not making mistake. If either way the tenant must pay for appeal, he probably won't appeal since he doesn't have money to pay rent or not willing to pay rent. He probably bluffing to buy out more time.

UPDATE ; We won eviction case against the tenant, and the judge give 5 days to appeal or move out. The tenant talked to my agent service if we can give him until the end the month of April. Should we give him till the end the month or don't?. My agent suggested not to play hard ball just in case if he appeal, it will be no good situation for us that the court will be give another 30 days hearing process and we have to spend money to hire an attorney for higher court. Would like to hear from anyone who familiar with texas tenant law. Thank you in advance.

I have sent the notice to vacate March 8th, then decided to hire eviction service so they can do the right way, This agent filed on March 29, it i hired him on the 16th. they took long time to handle my case. Got court date on April 12 but the judge change the date to 19th after the plaintiff requested for continuance. The law really needs change, who can we write up to? Judge? i think we need landlord protection law. Yes there is bad landlords out there but there is more bad tenants than bad landlords in my opinion.

@Nathan Gesner No problem, I appreciate your concern. Thank you anyway.

@Greg H. Yes you are right I am using the eviction service. I spoke with my agent, my tenant wrote up the letter with the doctor document. ( which is i don't trust him anyway, you can always ask your doctor a favor, might not serious issue and they can always make it up).

Regarding the judge question for how much rent is due, if the plaintiff will say march rent amount. so the judge will give the judgement for that amount? how about the April/current month?

I am suppose to have court date on April 12th for eviction, just found out today the judge change the date. The tenant callep up on friday April 8th to extend the court date, given an excuse medical issue. I don't trust him as far as i can throw him. He texted me he was on the hospital on March 14 when i tried to collect. So The judge granted and give another a week continuance to April 19th. Yes another week! then it take another 5 days to moved out in state of texas. So expect 1 month free rent, his deposit wiped out for March rent. What shall i do?, wish i can make this person crawling under.  Sick my stomach!

UPDATE; Just found out from the eviction service, he texted me a copy of the document. The court granted my tenant for continuance until the April 19th for some kind medical emergency. This is bogus! this tenant had been making excuses from the start for making late payment. This tenant went to hospital on March 14 last thing i communicated with him. So he uses this for dragging more time, i don't believe him at all. What should i do ? any similar case?
