Sure. I'd definitely have someone else take a look at it, but it's just a simple option contract that states that it is non exclusive for the seller. I wouldn't advise using it all the time, since you definitely want to have control over the property.

That seems very high for a deposit. You can offer much lower and just say "company policy is..." Or, you might offer a non exclusive option contract, so that he doesn't feel he is wasting his time. In this case you would run the risk of another buyer coming in, but you would still be able to market the property, at least.

I could be way wrong. But, doesn't that restriction say something about not being able to resell for 120% of the purchase price? Could you still secure them if you stay within that?

I think your first step should be deciding on some goals. Without a goal or plan, you can't correctly find out how to get anywhere specifically. Do you want to be a long term buy and hold investor, a flipper, wholesaler, etc?

I am currently hanging mine with a broker that doesn't charge any monthly fees, and they don't even care how often I do anything. For instance, I have been pretty active with my investing, but I only use my license for my own investing purposes. I went to the office for the first time in over a year last week, and they were really excited to hear about what I had been up to and were very helpful.

Definitely do some looking around before just making a decision.

I wouldn't think it would be uncommon at all to collect a non refundable deposit. It may not be the whole assignment fee, but at least it is something.

I'm not a lawyer, but I would assume you would be dead in the water. Unless, the buyer is willing to take it without title insurance. I don't know why the buyer would want to sue you to sell if you won't be able to provide marketable title, that wouldn't be the smartest idea, in my opinion.
