A judge could never force a sale in a situation like this. Big difference between a foreclosure, or divorce and a contract to sell dispute.  

A. No, if the seller isnt willing to sign on the line that is dotted, right shmite. nobody can make an owner sell a property, but they could face litigation for not doing so should damages occur.  escrow still being with the title company is irrelevant. Did the buyer request it back and the seller refused? If they refused, maybe. 

B. Yes, no. Only thing to consider is giving back the deposit unless non occuring transaction was somehow buyers fault, and facing litigation from the former buyer....but its an expensive ordeal, they probably wouldnt win, and again the house would not be theirs unless the seller sells it.

Solution? Avoid court. Have a meeting.

If you buy a property with that contract provision, you provide a deposit, then your title company turns up a bunch of those liens on the property, then you refuse to buy the property as a result of those liens, your deposit is history. 

I would have a title company research it before providing a deposit. Or not buy it. 

If you walk into an occupied house that the occupant doesnt want you in, you might be playing with your life. The only way to force entry is with a sheriff, and a court order with him/her. Unless the tenant allows you in, do not enter. Holding over=file for eviction, then evict.

Evaluations are house specific, good and bad to everything. Multiple units to spread risk good, sometimes multi unit tenants dont get along. Bad.

Barclay? Also good and bad. Good, being rehabbed in places. Bad, still part of baltimore.
