The tenant paid me the rent for this month 20 days late. Now we have court on the 1st (Thank God it fell on that day). Since the court documents says if it falls on the 1st or after she will have to pay me next month as well to get this dismissed.

Now the issue is the tenant is claiming she didn't get anything from court. I told her I will contact the court on monday to find out what happened.

I also recorded the tenant conversation with me for my safety and just in case I need to use it in court. This is legal right? since I'm involved in the conversation?

thank you everyone for your reply.

In my state: I have to send out letter to cease late rent payments. Then I have to wait for 1 or 2 more late payments (conflicting information online) after that to file for eviction based on habitual late payments.

I'm finding conflicting information online. 1 says landlord cannot evict when lease ends. another states that there is an exception to landlord occupied properties.

I have a tenant who was paying on time. Now the tenant paid late the last 5 out of 7 month. I charge about 10% late fee after the 5th of the month. and a flat rate fee each day after.

This month I still haven't recieved the rent. I'm constant contact with the tenant via text and the tenant has an excuse everyday for the past week. everyday I'm told wait until tomorrow morning, in the morning I'm told I will bring it at night etc.

Today I filed a complaint in court but it will take 3-4 weeks for a hearing.

My question here is:

Can I still evict the tenant or end the lease since almost each month the rent is late?

Another question: When the lease ends can I kick the tenants out?

I'm currently looking to purchase a property and it has a fully finished basement.

The basement has 1 bathroom and 1 room.

If I were to buy this property and rent out the 1st floor apartment which is 2 bedroom 1 bath. Can I advertise it as 3 bedroom, 2 bathrooms? and legally allow the 1st floor tenants to use the bedroom and bathroom in the basement?

Hello everyone,

I joined BP last year and learned a lot but I didn't have the funds to start buying. I currently own a multi family property in Bayonne, NJ. I rent one apartment and live in another. My goal is to have enough rental properties where I can quit my day job. I currently can't borrow because my income to debt ratio is too high (Only debt is my current mortgage).

During the period I have been gone from BP community I was investing in the stock market (stressful). I had some money but not enough to even put down as 20-25% on investment properties. After a stressful 6 month in the stock market I managed to make 28% return.

Now I would love to invest in NJ but I have no idea how can I get financing with such high debt to income ratio. I can afford to put down up to 25% on a property.

-I have been looking for owner financed properties but I can't find any!

-I really forgot all this stuff but would a hard money lender fund an investment hold/rent property If I can put down 20-25%?

Jerry I'm just trying to get information to see what's my best option for my current situation. I definitely wouldn't move out for this especially that I haven't had any major expense But I will keep this in mind. Thanks a lot!

I own a 2 family house in NJ. Currently if I make any repair in the house I can only deduct half of it on my tax return since its 50% owner occupied and 50% rented.

If I open an LLC will I be able to deduct 100%? is it worth it?

Will I be able to do that with my current FHA mortgage?

its couple of blocks away from my house so yes I will manage it.

I currently have 2 family house couple of blocks away and I pay $1073 for insurance. So I estimated $2000 for 4 units.

NJ highest real estate taxes in the nation.

And yes you are correct I missed maintenance and also vacancy although vacancy here is rare. easy access to NYC. When I bought the house I currently own one of the apartments were rented before I even had a chance to move in myself.

How do I go about talking to the owner directly? Do I get Realtors involved or look up his/her info and contact myself?
