high income to debt ratio. Example 99%. 99% of my income goes to my debt. Lol I hope that clears it out.

I currently own a duplex and I have been renting 1 apartment and living in the other one for 4 years with great success dealing with tenants.

I want to expand and buy another duplex and rent it out.

I have 20% to put down but I can't get a conventional loan due to my high Income to debt ratio (because of my current mortgage).

What are my options?

I tried speaking to someone about no doc loan and was told I need 30% down and it will be 8% interest rate.

Post: tenant evicted middle of the month? Take whole month from security deposit?

I have a tenant who is always late on paying rent. I issued the tenant 2 notices to cease and 1 notice to quit. Then I filed for possession. He didn't show up to court then on the day of the lockout she went to court and the Judge ordered me to come and show cause.... Even though I did that already (on August 12)... I went today September 2nd and showed cause (quit notice, rent receipt). The judge gave the tenant 7 days extension for orderly removal. Now here is my question.

Can I deduct the September rent from the security deposit even though he is staying until September 9? I won't be able to find a tenant till the 1st of next month and that's why I want to do that.

@Mina G.   You need to file to evict based upon NJSA 2A:18-61.1(j).  You need to send them the letter certified 1 month prior to filing suit just so you know.  AND you need to reference the above in the letter.  You just can't say you terminate the lease.  You have to go to court and have them terminate the lease and show all your documentation proving your case. 

Also you should know that Grace periods in leases in NJ are only for small protected class.   I eliminated them on my leases.  Rent is due first or before the first of the month or they get hit with a late penalty.

In today's day and age of electronic payments there's no excuses to not paying on time.

I sent that letter in to the tenant certified. and I also posted it on the door, and captured an image of her taking it off (from my security camera). My plan is to go to court 30 days from the date the letter was posted to file for eviction based on habitually being late. Do you think this letter will hold up in court for eviction? (I gave her 2 cease notice before).  Or should I rewrite the letter and send it again? If so can you please message me a template or wording on how to include the above?

I also filed for eviction few days ago because they still didn't pay this month yet.

even the light switch. there is 2 light switch. 1 next to the closet and 1 in the actual living room.

there is 3 windows on the other side.

I really think this was a bedroom way back because of the in wall closet. and all the windows, radiator, etc. there is 2 of everything in that area.

I have 2 family house the first floor is 2 bedroom the 2nd floor is 3 bedrooms.

I have attached a image of the current setup and what I want to add. Black color = current walls.

Green color = walls I want to add.

one thing I dont know what to do about.

There is a hallway when you enter the apartment. If I add the wall it will be in the middle of the hallway.check the attached. How should the shape of the corner be near the hallway?

I change locks. about 20 dollars on amazon.

You shouldn't have a habitual late paying tenant. Do they pay late each month or are they behind by more than one month?

They pay every month but 10-20 days late. I go to court and file for eviction on the 6th of the month. (I have them on a grace period till the 5th of the month).

Here is what I used:

1. Pursuant to a written lease (the "lease") dated xxxxx, you are a tenant for the premises described as xxxxxxx (The "Premises"), of which you now hold possession.

2. You are in violation of the lease by being habitually late in paying rent. Since the start of this lease you have been late xxxxx.

3. Due to the above mentioned reason, the Landlord hereby elects to terminate this Lease.

4. You are given at least 30 days notice to quit the Premises in compliance with the applicable laws for the State of New Jersey. Accordingly, the Tenant must vacate and surrender the Premises to the landlord by xxxx. (If all rent are paid up to date). If rent is not paid eviction process will start prior to that date.
