Finished room in basement & bathroom
I'm currently looking to purchase a property and it has a fully finished basement.
The basement has 1 bathroom and 1 room.
If I were to buy this property and rent out the 1st floor apartment which is 2 bedroom 1 bath. Can I advertise it as 3 bedroom, 2 bathrooms? and legally allow the 1st floor tenants to use the bedroom and bathroom in the basement?

I'm licensed as a real estate agent in NJ and as far as I know you can not market it as a legal bedroom if there is no access to the outdoors from the basement itself, i.e: a walk out basement or bilco door.
