@Theresa Harris -yes it was a big mistake and I feel like he will qualify and now I'm kind of stuck with the lower rental rate. My concern is if he does meet the criteria would I need to treat it as a new tenant? do a move in checklist? I wouldn't want to repaint the entire place esp with the reduced rent? would I just put on the checklist walls are average? etc not excellent condition as it was when she moved in years ago?

BP! 

Do you think it's easier to evict for non payment of rent/past due rent? or for a holdover tenant? that didn't move out when the lease expired?

Hello all,

I have a long term tenant for over 8 years and I no longer want her in the property- every month she is late on the rent. I have always tried to work with her when I should have not been so lenient. Lately it has gotten worse and worse like for example for Sept she hasn't paid anything yet and plans on paying half tomorrow and the other half on the 28th with the late fees. My question is this. The lease she signed when she moved in 2014 ended on December 15, 2015. I did not raise her rent for 7 years so I did not send any renewals or vacate notices (I know now bad on my part!!!! ) last year around this time I sent her a renewal or vacate with an increase of $65 (rent is still way under market rates I know don't yell at me lol) she signed and agreed to renew for another year with the increase so we did that. My question is I just noticed that I MESSED up and put the renewal letter she signed and agreed to with an expiration date of Nov 30, 2022 instead of Dec 15, 2022? since her original lease she signed when she moved in was for Dec 15? is that okay? should I be concerned about this now? would it stand up in court and which date would I use? Hope that makes sense?

Good evening! 

I have a long term tenant (going on 10 yrs and the rent is way below market rates). Tenant lease is up in 60 days so I sent the renewal and or option to vacate with only a $45 rent increase (I know I should have increased it by like $400 to bring it up to market rent in the area) my question is tenant wants to vacate but tenants adult child would like to stay and take over the lease. Tenant's child has been living there as well for the past 10 years. Suggestions on whether I should consider this or not? Obviously, I would make sure he meets the income requirements but the place does need some updatings and repairs so i'm not sure how to handle it? she has been a very good tenant over the past 10 years. How would I handle the move in checklist and the lease? if he was just taking over? I guess it would be considered a new tenant but she would want to transfer her deposit to him and the move in checklist when she moved in everything was in excellent condition and now it is not? not sure how to move forward. Looking for suggestions/advice as I have never had a situation like this before. Thank you everyone!

Hello all,

I have a tenant that has been w/ me for 9 months and I plan on sending her a letter of non-renewal. She has been late every single month. I have a few questions that I need help with please! 

1. Do I need to provide a reason in the letter I mail her 60 days prior as to why I am NOT renewing her lease? 

2. What if the lease end date arrives and she doesn't leave the property? I think I just need to file for eviction as she is a holdover tenant right? but I do not  have anything in my lease about holdover tenants? Do I give "notice to vacate" 15 days? on the first date after the lease expired and just send it certified mail?

Thank you all for your help! Just an update on how this turned-out LOL. Since I didn't feel comfortable sending it via email - I told and told her we could meet in person that way she could review it and I could answer any questions she might have. Then if she was in agreement, she could provide the full security deposit etc. She never answered and I never heard back.

My policy is for them to provide the security deposit - in full - within 24 hours of approval. If they don't pay the deposit, I keep it on the market and offer it to the next qualified applicant. This 24-hour period would also be appropriate for her to review the lease.

I would ignore her. If she's serious, she can put the deposit down.


Nathan so you would suggest not sending the lease then and just ignore her then even though she paid the application fee and i told her she qualified and asked for the security deposit which she said she will not give me until i email her a copy of lease to review first. I did not advise that deposit is required within 24 hrs. I will note that for the future. If i ignore her, can that potentially cause an issue to arise where she might want a refund of the app fees

@Galen Ikonomov - what would you say as to why you WILL not email it to her? Just that you want to do it in person to address any questions/concerns? and if she does not want to do it and wants it emailed? would you send it and just continue looking for a another tenant?
