Post: Tenant replaced stove without my knowledge and now issue with stove

Hello,

Tenant lived in unit for 9 yrs. Gas stove was new when tenant moved in. Tenant vacated unit last week and we noticed a different stove in unit. We questioned tenant and they said about a month ago the stove stopped working so they replaced it with a used one. We further questions why they did this without our Knowledge and we inform them that they were supposed to let us know if they were having a problem with their stove as it is the landlord's responsibility to repair or replace not theirs unless it was damaged caused by them. Needless to say, now the stove isnt working properly, the broiler function isnt working and there are a few other issues. We have a repair guy coming this week to check it out. Question is how would you handle this? If its repairable would u deduct part or all the costs from the security deposit? I know life expectancy on a gas stove is 15 years so I only had maybe 6 years left but why did the tenant inform me of this why did they do this behind my back why didn't they leave the old stove there so I could see that something was wrong with it maybe it was good that they tried to fix it but the still that's there is having an issue and I need to make sure that it is safe for the next tenant what if the stove is not fixable what would you do would you buy a brand new stove and have the tenant that just moved out pay for half of it for all of it how would you proceed with this looking for suggestions and advice thank you so much guys

All,

With medical marijuana being legalized in my state I have some tenants that are smoking it inside the property do you believe that this can cause the same damage as smoking cigarettes inside a property do I need to add a new Clause to my new leases moving forward and have current tenants sign an addendum?  what is everybody's thoughts on this ?does anybody have any examples of a clause or addendum  that they can provide please ? Thanks

I was just wondering what everyone does when they are not renewing a tenant's lease because they have been a problematic tenant. Do you provide them with a reason why you're not renewing in the letter or do you just send them a letter and include something basic generic like this?....   " this nonrenewal leased letter shall act as official notice that your lease will not be renewed for another lease term for the property located at xxx. Your lease will expire on June 30th 2023, which means the property should be fully vacated by that day. You will still be required to pay May and June's rent. This is your 60-day advance notice prior to the termination of your lease or tenancy this notice of termination serves as notification of the termination of your lease.

Hello all,

A couple w/ 4 kids. She has been at her job for 4 months. He has been at his job for 5 months. Prior to that they were both at their previous jobs about 1 yr. She is living w her sister and he renting a room and they want to move in together. She put her sister as her landlord reference.

Would it be okay to deny based on too short of a time at jobs based on not having stable and reliable income

and also include in the denial letter that she doesn't have a landlord reference? 

would you agree w/ this ?

Hello,

A  long-term tenant just moved out and i have a clause in the lease that states that the tenant was not allowed to smoke inside the property however there are smoke stains on the ceilings and ceiling tiles throughout the property. Its hard to tell on the walls as it seems they tried to repaint them the same color. The house smells like cigarettes too. Would you charge them and deduct from their security and if so how much would be fair?  Also, is kilz paint the best cover up these kinds of stains

Hello,

Do you charge an administrative fee when drawing up an itemized list for the security deposit refund? if so, how much? does it vary by state? 

this is from google?  property owners operating in the state of Pennsylvania who collect the security deposit of more than $100, and place it in an interest-bearing escrow account, must pay the interest earned to the resident each year. Property owners may collect 1% of the interest as an administration fee. 

what if you didn't put it in an escrow account? how do you know how much interest to apply?

Hello All,

When a tenant moves out of your property and hands you the keys but doesn't provide a forwarding address do you ask them for it or do you wait till they provide it and if they don't do you just mail the itemized letter / security deposit refund check to the address where they lived at your property?

Hello,

tenant moved into the property in Sept 2022.

Now wants to break lease because she got approved for housing assistance and has 3 kids and is a single mother. Says she has been on the  waiting list for 5 yrs and does not want to lose this opportunity

I told her we could talk with housing and her staying at the property because I do have other housing tenants but she's saying that this is not an option that she has to live on their premises she cannot live in a house outside of that premise .

I then proceeded to advise her that I do have a clause in the lease where she can buy out and break the lease by paying the two months buyout claws fee and she's not willing to do this but she wants me to work with her and to please help her because she's a single mother she was mentioning that she might have another family member that would be interested in the property in that I could see if I would approve them and they can move in and let her move out but at the same time I feel like that's not fair because then I have to go and do all this paperwork again when she just moved in a few months ago and drop new leases etc etc I'm looking for advice if anybody's been in the situation how would you handle it what do you think I should do thank you so much

Hello,

half of the time we go do a repair the tenants on the lease are not there at the property and someone we dont know is there. When scheduling repairs tenant says i will be at work but can have someone there. I called gas comp bc i have a feeling and they said the gas isnt in either of my tenants name? Is this enough evidence? Prob not right bc they can give some excuse abt deposit required so put im friend name etc?
