Post: New tenant wants to break lease please help

Hello,

tenant moved into the property in Sept 2022.

Now wants to break lease because she got approved for housing assistance and has 3 kids and is a single mother. Says she has been on the  waiting list for 5 yrs and does not want to lose this opportunity

I told her we could talk with housing and her staying at the property because I do have other housing tenants but she's saying that this is not an option that she has to live on their premises she cannot live in a house outside of that premise .

I then proceeded to advise her that I do have a clause in the lease where she can buy out and break the lease by paying the two months buyout claws fee and she's not willing to do this but she wants me to work with her and to please help her because she's a single mother she was mentioning that she might have another family member that would be interested in the property in that I could see if I would approve them and they can move in and let her move out but at the same time I feel like that's not fair because then I have to go and do all this paperwork again when she just moved in a few months ago and drop new leases etc etc I'm looking for advice if anybody's been in the situation how would you handle it what do you think I should do thank you so much

Hello,

half of the time we go do a repair the tenants on the lease are not there at the property and someone we dont know is there. When scheduling repairs tenant says i will be at work but can have someone there. I called gas comp bc i have a feeling and they said the gas isnt in either of my tenants name? Is this enough evidence? Prob not right bc they can give some excuse abt deposit required so put im friend name etc?

@Kevin Sobilo so in your opinion if i  have an issue for example w/ a tenant and they called city code enforcement on me because some repairs where not completed in a timely manner in their point of view and i do not wish to renew their contract in 5 mths when it expires do you think i could have an issue where they say it is "retaliation" on my end because they reported me to code enforcement and building standards. The city inspector came out wrong the list of violations and gave me 30 days to comply.

Hello,

What does this mean? 



No individual unit lease on residential property shall be terminated or nonrenewed on the basis of the participation of any tenant or member of the tenant's family in a tenants' organization or association.

@bob willis this is what i am not certain of? Since they have been late for a very long time and last year we renewed the lease it might be seen as this yesr we aren't renewing because they reported us to code.

Hello,

Tenant has been with us for 6 years over the course of the last year they have been late almost every single month on their rent and we have been working with them they always paid the late fee but they have always been late . Recently there was a leak we fixed the leak but we still need to repair the wall / ceiling we are in the midst of doing this and they knew that and they went and called code enforcement to file a complaint on us which we kind of feel it's like they stabbed Us in the back . The question is we were not planning to renew their lease either way because they are constantly late and their lease is up in 5 months so if I give them the 60 day prior notice to the least expiration date that we are not renewing would that be looked at as us retaliating against them for them calling code enforcement on us I'm concerned about that and just wanted everybody's opinion and input or do you think I would be better off offering them the option to renew the lease and up in the rent about $300 or $400 since it's way under Market rent for the area and maybe they'll choose on their own to leave and that way they wouldn't have any means to argue that I was retaliating against them thank you all for your help I appreciate it

Hello all,

i sent tenant certified letter with 60 day advanced notice of non renewal of her lease. She is sending me tons of text messages asking for a reason as to why she needs to leave and telling me she has no where to go.

Some history about the tenant:

Sec8, rent is 500 bucks a month below market rent, been there for 5 yrs. Husband is very rude and disrespectful. When we ask him something he wont answer or kus screams at us. She Pays her portion of rent on time. She has been looking for about 2 yrs to move out but cant afford the new rents in the area. 

So now she is questioning why she needs to leave if she hasnt done anyrhing and saying im being unfair. So if at any given time she were to find something she would up and leave and doesnt care how it would impact us and he ramifications if would have to us? So that is one of the reasons we decided not to renew her lease.  she doesnt want to live there anymore if she is looking for a new place. And we also decided since we can fix up and rent for 500 more a month why not and also her husb who is also on lease is not pleasant to deal with is rude and disrespectful he yells and screams he carries a gun that I guess he's licensed for but he like keeps it visible kind of like he's trying to intimidate us or he'll leave it  right by the front door when we walk in sp its im clear sight?

so I just would like to know if I need to give her a reason and looking for suggestions. Perhaps something along the lines of our relationship has gone south and we are not getting along anymore. Its an uncomfortable situation with your husband? Or should i stick to a reason around her not being happy there anymore which she expressed to me verbally several times that she is vigilantly looking for a new place

i agree with that those were my thoughts as well its a long process, this was planned he had to know she was coming if even what he is saying is true. My question is what do i do if the person doesnt pass the screening? Being he just moved in on 1/16

what fee and how much would you recommend charging? Can you please provide more details about this. So would I need to draw up a entirely new lease or can i add to existing or just do an addendum after having them fill application and run the background check?
