Post: how to dispose abandoned personal property of a trustee sales

Hi James, we buy a lot at the LA county trustee sale and have encountered this problem post eviction.  Most of the time when we purchase a vacant property with personal belongings we just throw them away (but it's always junk, nothing valuable).  As far as the vehicles, you need to do a lien sale for each one.  We have a guy who does them for us, but I know other investors who have done the lien sales themselves and say it's pretty easy.  

As far as other valuable personal property (furniture, tools, electronics, etc.) there's a similar process for that.  It basically goes to auction, and if no one shows up to bid then title transfers to you.  We have had tenants get evicted and try to set us up by leaving valuables then trying to sue us after so it's worth being very cautions when it comes to documenting everything left behind and taking all the right steps along the way.

Hi Alan - I looked into probates about a year ago.  I believe in order to get the info I had to go into the probate court, get on one of their computers, and get info printed out.  I also would have to look in each file to see if there was property in the case.

I'd recommend looking up Paul Horn, he does seminars that are very good.  You can also pay to get weekly emails of new probate cases.  For me it was worth paying to get those leads because it's so time consuming to get them on my own

Yes it's a 1953 house.  Many properties in my area were built in the 1950s.

I am going to paint the interior, replace the carpeting with vinyl plank, and update the closet in the kitchen to turn it into a pantry.  I also have a foundation issue to correct.

Are most of your properties northside?

 Yes everything I have is on the northwest side.

 If you don't mind me asking, what do you like about the northwest side of the city?  what factors made you target that area?

@Stone Teran what's your strategy for getting tenants out in areas with rent control laws?

@A Bee - that's tough. I would just be honest and say you want to make improvements to the unit and raise rent.  They either know rent control laws and will fight you, or they won't and they'll accept some $ to move.  I purchased a duplex last year and ended up paying a total of $12,000 to get both units vacant.  They knew the laws and that they could possibly get $19k each, but at the same time they didn't want to go through the court relocation process so we were able to work out a deal.  They just wanted to find a better place to live and move on with their lives (the property needed a LOT of work)

Is this in the city of LA?  If it is, it most likely falls under rent control and the relocation fee is something like $19k.  Have you tried talking with them to see if they would be willing to move?  You could try offering a few thousand and hope they don't know rent control laws?

Hi Johnathan - I am a realtor and investor in Orange County.  I live in Dana Point and my office is in Costa Mesa.  Lately I have been doing a lot of multifamily investing, mainly up in Long Beach.  But there are a few pockets in Santa Ana with reasonably priced duplexes.  Feel free to message me if you want any more info
