I have a building in the back that was getting worked on. The equipment was left back there. She didn't have access since May. But she only had access it was not part of her lease just like the rest of the tenants and no one else complained. The other tenants sound like you're tenant it's more of a family there everyone gets along except for her. She doesn't even get along with the man who was at one time her boyfriend now roommate living there... the investors are the people that are in the other project with me

So this is my response still waiting for her to respond

Both you & tim occupy the unit & are thus both responsible I will communicate with both on this matter..Since we couldn't fix the boiler the same day & you didn't have heat for 3 days & the weather was in the 40's but below 55 although legally, I'm not required to give a concession, but I understand that it sucks to not have heat I am willing to let you take off $120 for the inconvenience. I hope we can compromise the situation. We will not be deducting anything for the backyard work.

@Matt Faix thats the approach i want to take but the other 2 tenants didn't complain & they been there longer ...IDK if by giving the discount I will start a bad trend with tenants using the I will not pay rent until you fix blah blah blah ect..

Also guys this is what the lease said

Reasonable Time for Repairs: Upon being notified by Tenant that there is some building defect which is hazardous to life, health or safety, Owner shall undertake repairs as soon as possible. Should there be a delay of more than 72 hours in making repairs, due to a difficulty in scheduling the work or obtaining parts or for any other reason beyond Owner’s control, Owner agree to keep Tenant informed about the progress of the work.

wow thanks for the quick response BP ... I feel the same way as you KristopherHanks... But I can understand what Michael Gansberg is saying I will look into nyc law right now... Thanks again. I don't want to be mean but this lady is a complainer

Hi BP I received this text message below today from my tenant. Here is some info on the situation. Her lease has been over for 2yrs now so she is on a month to month lease. In her lease it stated she had access to the yard along with the other tenants in the 3 unit house. This summer I was doing work so no one had access. This December my boiler need some work & I couldn't get anyone there for 3days. Need some advice on how to handle the situation. Do i take off some money or tell her to keep the rent & vacate the apartment within 30 days...

Hey will just Checking in about:  1. How much to take off rent for heat not working first week of December.  2. Your discussion with investors regarding backyard work
Haven't paid rent yet - waiting on this information. Please communicate with me (not tim) on this stuff as I will be paying rent going forward
