I purchased a 3 unit building several weeks ago. Recently, I signed up one of the pre-existing tenants on a new month to month lease. One of the tenants has a car in the yard. I told her at the signing (and wrote it in the lease) that the car must go immediatley. Nothing has happened yet. I mentioned it again to her. She said something like, "it doesn't work ..how will I move it, blah, blah etc." Being the holiday season, I am guessing money is tight for this young woman so I hestiate to press to much, but the dang car has to go. I am cleaning up after a former landlord that really let the condition of this property and the next door propety go into disrepair. I close on the second building in 2 weeks. Part of my intentions are to clean up the properties and run a more respectable operation.
How would you handle this car issue?

Its in the attic, so damage in limited and rentals not affected.

Had to do my first evictions the other day. Not fun. Exhuasting actually, and dirty. I removed 5 pigeons from the attic of my resently purchased 3 family. Non-payment, cleanliness and noise were all issues with these characters.
As I stood, ankle deep in pigeon feces, I thought, "Yes, landlording is glamorous."

those little staples are a nightmare . i spent several hours the other day clearing a floor of them.

I inherited the place with no written lease. I just purchsed so....my new lease which they haven't signed yet says "no dogs." The understanding they had (for what its worth) with the former owner was "no dogs." Of course that "understanding" isn't worth much. I think it will have to be "no dogs or no tenancy." OK, don't sign and I will give you noticed to quit on Dec. 1st. But I know they will BS me and say the dog is there temporarily or some other excuse. So, we are starting off with a lease that is already broken. Bad way to start a relationship.
Maybe the extra rent and deposit route is the best. Oh, I forgot to mention they have 5 cats which I don't mind. But now we have 5 cats, 1 dog, etc. Where is this going? Its an apt. buiding not a zoo.
I know they will sign what I put in front of them. But am I going to be giving notice in a few weeks becasue the dog isn't gone? Thus prolonging this problem and not solving it.

Yeah, maybe the extra rent/deposit route is best. I just don't know.

I just bought a 3 family. Two vacant units. 3rd floor has a young couple. Prior to the purchase I spent time around the property and saw a young guy (not a tenant) going in and out of the property with a small dog. When I finally purchased the prop. I had my first sit down with the tenants. I was introduced by the former owner and went over a few things with the tenants. Again, this young fella was there with the dog. I casually said, "oh, do you live here." " No", he say. I then asked the tenants if the dog was theirs. "No, " they said. Well, Tuesday I sit down with them to sign the new lease. I told them twice no dogs. Well, today I was working in the building and I could clearly hear the dog running up and down the hallway of the apartment and no one was home.

How do I approach this one?

There is no written agreement. Verbal, month-to-month, $600 per month.

Dear Ms.YYY,
Please be advised that the property at 345-349 Main Street has changed ownership officially starting November 16, 2007. The new owner of the property is the corporation 345-349 Main Street LLC. The management will be handled by the corporation's representative xxx. Mr. xxx can be reached at 000=000=000.

In accordance with the change of ownership, a new month-to-month lease and required addenda must be signed immediately.

If you wish to remain a tenant at 349 Main Street, and agree to all statements below, tenancy can continue with a month-to-month lease:

• The rent is due in full on the first day of the month. The check can be left in your postal mail box to be picked up by the property manager.

• All public areas are to remain free of debris and personal items. These areas include hallways, porches, rear and side yards. In addition, all un-registered cars must be removed from the property.

• The property manager must be furnished with contact information for all residents.

• A late fee in the amount of $25.00 is due for all late rent payments.

This letter serves only to outline the corporation’s general requirements for tenancy. This is not a lease. Please call xxxx to set a day and time to sign a month-to-month lease.
