A title company searches title, can act as a closing agent. Its back end carrier provides title insurance against claims. These are separate but potentially connected parts.

The attorney, representing you, can generally order the title. You will be responsible at the closing for all incurred charges done on your behalf.

You, the seller, each party's attorney, the title company; they all play a role for the closing.

ALWAYS!!! Use you own attorney. If you use the seller's attorney, there is an inherent conflict. Even if there is an acknowledgement that the attorney represents both parties, be realistic, who'll represent you if there is an issue? You won't buy insurance just because someone shook your hsnd, why would you use theur attorney. The same holds true for title companies. Always use your own.

Let's not over-complicate matters.

If you can pay off the mortgage and costs, i.e., all of the foreclosure costs, plus the owner buyout, just do it. The right if redemption exists up to sale. Who needs a lawyer? Pay the bank, pay the owner, take back the deed. Seems straightforward enough to me.

I host a MeetUp. This Meetup can be found on MeetUp.com. Mine is not on Zoom but there are many in the Hudson Valley that are including ones out of Fishkill, Orange County, Poughkeepsie.
