Then you can have negative appreciation and negative profit instead.If you're not comfortable feeding an alligator (negative cashflow property), then don't "swim" in the "appreciation market".

For example, tenant recieves TOPA notification, contacts attorney, attorney finds some ridiculous reason to litigate, says "oh, don't want to hold up your sale in a nasty lawsuit, my client would like $30k and we will drop the suit and they will waive their TOPA rights."

That's basically what an appraiser would do... since below grade doesn't count towards GLA, whatever is below grade is a "feature," like a swimming pool or solar panels.
