They don't generally have ill intentions but aren't aware sometimes of the ramifications seemingly minor actions have on the property.The answer for me is lots of on-boarding and coaching, some tolerable inspecting, open communication and trying to align their interests with mine.

We don't use title companies here.That said, marketing a property you don't own is illegal in MA if you are not a licensed real estate agent working under the supervision of a broker.In addition, if you put a property under contract without both the intent and the ability to close on it, you could be sued for "fraud in the inducement".The only legal way to wholesale (which isn't really wholesaling) is to close on the property and then resell it.

If there is no one else in your market wholsailing or marketing for off market deals then you can spend a lot of time and money educating your market that it is socially acceptable to sell at a discount to you.Some states are cracking down on assigning of contracts if you have no intent to close on the contract if you can't find a buyer it can be considered brokering without a licence.
