You can check with the local city department to see if permits were ever pulled and if city ordinances allow for the space to be legally rented out.

She was actually the one that told me we need a lease agreement setup to show the current home will no loner be our primary residence but we didn't know we needed a deposit from the tenant.Generally you will need a lease and deposit (lender depending) for your departing residence. you can only use a FHA loan if you do not currently have one and the new primary residence is 100 miles or further away from departing residence.

I would talk to the town building department and planning departments and see what would be needed to allow that to happen (sometimes there are egress requirements, etc).
