Honestly, in your first syndication or fund you should probably expect to give the investors for since they are taking higher risk on someone who hasn’t got a track record doing syndicated investments.

Is there any sort of track record of whether or not a lender would give the borrower a hard time if the payments were current?

It may happen, but I am still thinking there should be some sort of protection in place where the first entity that records the transfer with the county recorder is the winner.

I want to write the owners a letter (I'm 3 hours away) explaining the situation and asking them to at least pay the legal and recording fees for getting it cleaned up. 

I friend of mine who's been doing this recently has been just looking up the owners through tax records and then looking up those names with a WhitePages subscriptionThat's what I would look at first , good luck !  

But you should be able to see from your survey showing the easement where it is recorded and go to the county clerk's website and download the original easement document.
