Matthieu Benoot Tenant breaching contract, what to do??

Universally, a tenant under a lease has the obligation to cover such breach of contract, but only to the extent to indemnify the owner, seeing to it you have no financial loss.You can collect rents while the unit is vacant, state law may limit the term, you can collect for costs of advertising in some case, but you can only collect to the date of a new lease.....and, you have the duty in good faith to actively seek a new tenant, you can't just allow it to remain empty and continue to charge the old tenant.

There are people who will try to push some sort of global "get-out-of-jail-free" cared (or, "get out of trouble with the state RE commission free" card), telling you that the Constitution protects wholesaling (not true), or that any contract can be assigned and that contract law will trump regulatory law (not true), or that by signing a contract you create an equitable interest that always and forever places you beyond the reach of state law and regulation (not true.)The real answer to the question, then, is "It depends."
