In the future I'd state no overnight guests if it's a roommate situation as part of the lease agreement.

I've heard on some BP podcasts of investors purchasing buildings that have some sort of HUD contract (basically gold).

He was a recent guest on the BP podcast a few months ago and only accepts clients who are active in real estate ownership.  

The status of the property is determined on January 1st of each year so since they owned it then the exemption stayed for last year.
