I've read that you are unable to agree to end the tenancy on a certain date as a condition of signing the lease, so you can't simply agree to terminate at the end of the 1 year before signing the lease.

Unless the party who lost the property can prove they paid the HOA and the sales should have been terminated anything short of that is a different subject and the HOA has no need to follow a RE contract.If the bank wanted to do something they could have paid the HOA lien in full added it to their debt and then negotiated further.At least that's how I see it

It seems kind of draconian (and unnecessarily costly via turnover on my end) to terminate her lease over this, so I am trying to anticipate what would be the next logical step if she doesn't comply after my formal letter to her.  

I would also require to be a certificate holder, this will notify you should the policy ever lapse or terminate for any reason.

Frankly, if you do not trust a potential lender that should be all you need to terminate the process.
