Was thinking of sending an email stating we may evict her but not sure how to do it without screwing myself later with a schmuck attorney  contesting on her side. 

I've never gotten payment for my bill, but I think it kept them from trying to contest anything.

However, it almost impossible to get a title policy until at least 2 years because of the right to contest the sale unless properly notified.  

A good attorney should also be up-to-date with the latest legal developments, including any changes in the law that may affect the eviction process, and should have the resources to move quickly in the event that the eviction process is contested.

It was really no contest.
