Hello

I cannot believe bad tenant was no show for settlements  hearing today medical emergency. 

Bad tenant filed answers all lies; i prepared all the documents and brought today to show to judge.

Lawyer said hearing is delayed one week from now and go back to court in next week.

Anybody has similar experience like me to delay hearing?

So stressful..

Sorry to hear you are going through.

I had one bad tenant like you have now she had so much excuse not to pay rent and security deposit.

I hired eviction lawyer and she hired defense lawyer to answer.

I was very shock bad tenant did not have a money to pay rent but had a money to hire defense lawyer? What the hell is that?

If person does not have money, move out asap.

Go to shelter to provide free housing.

Why stay someone else property to stay free?

When I read bad tenant answers, she wrote all lies and made up story.

I think your tenant was professional scammer like mine.

Dont be too emotional for eviction process. I know it costed money and time.

But you will learn a lot from this experience.

Stop texting her too.

Call the eviction lawyer and follow up eviction process.

In Ca, one year lease, 3 days notice pay or quit first; if you dont hear anything back from bad tenant; you will file eviction.

Get all documents such as leasing agreement, 3 days notice pay or quit, declarations to serve 3 days pay or quit, deed of your property, landlord insurance and all text messages printed out btw you and her.

Also, when you serve 3 days notice pay or quit, hire process server. You need to write all the name in your property live.

For example, she is only one who singed lease, she has husband, mon or 18 yrs older child, you need to write down all the name in 3 days notice pay or quit.

If you need to go to court, process server also needs to be attend it too.

Better to hire eviction lawyer and let them handle all the process.

Others have given you good advice on speaking in detail with your attorney - I hope s/he is prepared and experienced to deal with this properly. My suggestion is try to ensure your attorney is trying to minimize your losses in terms of both time to eventual removal of tenant (whether voluntarily or not) and attorney fees. You may or may not ever receive money that is owed to you by the tenant for past rent (hopefully, you will receive a judgement in which you can try to collect later), but the time the tenant continues to live in your property is rent lost going forward. In addition, the more time time the tenant stays, the more attorney fees will add up. In other words, try to expedite the process as much as possible.

In Alameda county, i guess before trial it is mandatory settlement conference first.

I will call lawyer to find more detail information and what will be my best choice not to lose money so much.

It is very stressful and time consuming process.

My property is located in livermore, CA.

I need to go to court alameda county, CA.

Bad tenant gave me bounced check security deposit and prorated rent on March. Until now she did not pay anything.

I hired the lawyer to file eviction.

Bad tenant filed answers by eviction defense lawyer; so my lawyer requested to trial.

Our Lawyer office sent email two different date.

One of them is pre-trial settlement conference and other master jury trial date.

Can you tell me what is pre-trial settlements and how to prepare?

Also, lawyer office sent email about tenant filed answers ; when i read her filed answers, all of them lies.

I never went to property since I rented out to her; her answer I went to property without 24 hours notice.

other stuffs, blah blah..all of them lies.

I was very shocked and don't understand why such eviction defense lawyer helped her to file fake answers. What kind of job they do?

Bad tenant like her, should not protect it by law; provided fake income, fake bank statements and fake credit score..

Bad tenant has money to drive BMW, fill out gas and buy grocery ; not pay for rent?

What's the point to have leasing agreement if someone does not pay rent and live for free?

Please, share your eviction pre-trial and jury trial experience.

Why do you feel guilty?

Like other people mentioned already, it is business. Tenants do not have funds to pay rent, they need to move out no matter what.

Your property is not free house or public shelter to stay.

In my case, Bad tenant gave me bounced check so I hired lawyer and filed eviction; waiting for court trial date. Cannot believe bad tenant filed answer? 

I learned very expensive lesson first time eviction. But I will keep moving forward.

You need to file eviction fast; dont wait too long and dont give too much time to tenants who dont pay.

I did screen tenant;  Credit score was 729. But I am sure it was fake.

Never never never take a check from a tenant.  I only accept money orders and cashiers check. Anything else is imaginary money.  Most people don’t have 3 times the rent in cash laying around without stealing from Peter to pay Paul.  While you thought you were Paul you were actually Peter.  

Sucks, consider it a lesson in this great life of real estate investing.

Also, found out tenant paystub was fake; I could not find company and I am sure her credit score was fake too.

I dont understand tenant provided fake income, credit score even bank statement; why bad tenant filed answer?

NEVER accept any form of payment for the deposit in any form that is not 100% guaranteed on the spot....i.e cash, cashier check etc...... it can take weeks to find out the check is no good and they are already in the property and its too late....

Never get personal check

Felt stupid and upset why I did not do proper screening check tenants this time.
