I had one bad tenant like you have now she had so much excuse not to pay rent and security deposit.
I hired eviction lawyer and she hired defense lawyer to answer.
I was very shock bad tenant did not have a money to pay rent but had a money to hire defense lawyer? What the hell is that?
If person does not have money, move out asap.
Go to shelter to provide free housing.
Why stay someone else property to stay free?
When I read bad tenant answers, she wrote all lies and made up story.
I think your tenant was professional scammer like mine.
Dont be too emotional for eviction process. I know it costed money and time.
But you will learn a lot from this experience.
Stop texting her too.
Call the eviction lawyer and follow up eviction process.
In Ca, one year lease, 3 days notice pay or quit first; if you dont hear anything back from bad tenant; you will file eviction.
Get all documents such as leasing agreement, 3 days notice pay or quit, declarations to serve 3 days pay or quit, deed of your property, landlord insurance and all text messages printed out btw you and her.
Also, when you serve 3 days notice pay or quit, hire process server. You need to write all the name in your property live.
For example, she is only one who singed lease, she has husband, mon or 18 yrs older child, you need to write down all the name in 3 days notice pay or quit.
If you need to go to court, process server also needs to be attend it too.
Better to hire eviction lawyer and let them handle all the process.
