@Kris L. is right--we accept ONLY certified funds (no cash, no personal checks) for 1st month's rent and the security deposit.  I'm sure you won't be making that mistake again.  Don't get angry, don't worry and don't dwell on how you were taken advantage of.  Just learn from it and keep moving forward!

 Thank you for your support.

In the future, i will accept only cashier check or money order for security deposit and first rent.

It is my first time eviction tenant.

Everything is new and stressful.

But I hired lawyer; hope everything is going smooth and well.

Personal checks for security deposit aren’t a good idea, so I would recommend not accepting them as a payment method on move in.

Yes, I learn very expensive lesson this time.

I was too lucky to have good tenants so far.

In future, never get personal check and more tenant screening.

Thank you.

Hello

I filed eviction not too long ago, called lawyer office today.

found out bad tenant got answered.

I cannot believe she gave me bounced check for security deposit and prorated rent.

What kind of answers she can do? speechless..

I am very panic now.

What should I prepare in next for court trial date?

Please, share your experience.

Thank you.

Make sure your lawyer has all the documentation they need. Things like the signed lease, bounced checks, etc.  You'll be fine.

I called lawyer office earlier; receptionist told me they will send email for court date and additional documents.

Thank you for your advice.

@Yuni Park  You should update your profile with your location, which would help.  Landlord-tenant law is very specific to state.  Your lawyer should be in the best position for the next steps.

Here in VT, if the tenant (defendant) answers, then they set a court date.  Your attorney should state "failure to pay rent as agreed in the lease" in court , and so on.  Again, it's your attorney that handles this.  Anytime I've been to court for an eviction, I typically call in and my attorney does all the talking.

Good luck!

 Thank you for your advice.

I just update my property location.

Luckily, I found out best eviction lawyer from this website; very supporting and thanks to Brian.

Hope this is over soon.

Why didn't you cash the check as soon as she gave it to you before she moved in?

 Right, It was my mistake.

I should get security deposit first before she moved in.

You should only trust paperwork the tenant provides if you can verify it.  If a tenant brings me their credit report and tells me that I don't need to run one since they have it, I tell them I have to get it run independently.  I can fake a credit report showing I have a perfect or horrible credit score.  It's easy.

Also, make sure you are evicting the tenants and all other occupants (or whatever your local laws require) to get everyone out.  If you do things wrong with the eviction you could end up having to start all over from the beginning, which will cost you time and money.

Thank you for your advice.

I hired eviction lawyer and filed already with all the occupants in leasing agreement.

Waiting for updated from lawyer office and moving forward in next step.

Eviction process is long and very stressful to me.

Hope she moves out soon.

@Marc Winter

Thank you for your advice. I will not give up just one bad tenant.

I filed eviction yesterday and process server will deliver to tenant.

It is very stressful and time consuming to all the eviction process.

Learned a lot by expensive way; should not trust all paper works by tenants provided.

I need to handle professional way and more tenant screening.

Hope this will be my first and last eviction to tenants in the future.

You need to hire eviction lawyer.

I heard SF is very tenant friendly; eviction process is not simple.

in stead of wasting a time, hire lawyer asap.
