@Ramon Copeland Its not gonna happen, the moratorium is through at least 1/15 and even if it weren't extended, which is doubtful, it will take at least 3-4 months to get through the backlog of all pending evictions in Schenectady, so it would be summer of next year before they were actually evicted. Are they not paying?

If you want an in depth breakdown of the Albany law, I wrote an extensive article on it on our website on venoproperties.com.  Expect this to spread throughout the state like wildfire, multiple other municipalities already have drafted similar bills and are just waiting to put it to a vote, and there was already a state-wide bill drafted in 2019 that is still in committee, this is highly likely to become statewide law no later than 2022.

Unfortunately not, in NYS ever since the HSTPA was passed in 2019, landlords and GOOD tenants have been stripped of all rights in favor of coddling the worst of the worst tenants, like yours.  Depending on the jurisdiction and your lease, you could attempt an eviction for lease violations, but those are pretty difficult to pull off and you would need to prove persistent and damaging behavior (you would probably need multiple neighboring tenants to sign affidavits attesting to such), you would need to prove you provided multiple opportunities to cure, and you would still need to follow the months long eviction process.  Your other option is that if they are on a month to month lease, terminate their lease with proper notice (30, 60, or 90 day depending on how long they've been there), then if they don't leave you'd still have to go through the eviction process.  And worst of all, due to covid, best case scenario right now is a 6 month runway to get through the eviction courts once they reopen.

Nope, if your tenant won't cooperate you're SOL, terminate their lease now and start the eviction process if you haven't already.  The New York State ERAP program is a total farce for landlords, the tenant MUST provide consent and all of the personal info (including tax docs) in order to apply, so a landlord has zero ability to apply on behalf of a tenant that's uncooperative, and most tenants that are still not paying rent right now are (and have been for months) uncooperative and have zero intention to pay ever, and give zero effs about whether the landlord ever gets their back rent.
