In regards to probate, What holds up a close the most? Is it the family or the paperwork/rules/legal side? Well as Rick Harmon posted earlier on this site but on the probate topic,

I doesn't matter what the transaction is - purchase, buy out, work out, financing, pending mortgage foreclosure - each player in an estate or trust deal has their own agenda based on self interest.

In CA., the three key documents when finding possible probate deals are; Petition for Probate, Order for Probate and Letters Testamentary (or Letters of Administration)...per Rick Harmon's knowledge as well.

If you run into a probate situation drop me a line. For a homeowner to sell a 'probate" property, Letters of Administration/Testamentary is required.

Your title rep is familiar with this.

Mary Sue, the Sac county website does NOT display addresses'. It would be easier if you had a property profile account through your title rep. (Chicago Title, Old Republic, etc.) for your searches in Sac county as well as Placer county. Also too, the town of Pleasant Grove is not that far from where you and I reside but it's situated in Sutter county. Go figure

In Sacramento county you can access the county clerk recorder website (http://www.ccr.saccounty.net/Pages/e-ROSI.aspx) You can perform search by party name and/or decade, year or date which includes Deed of Trust, Reconveyance, Grant Deed, Judgment, which are document titles against party name that also includes book numbers (19941221) and page (0045) Again property address is not published.

But this search won't help you with probate leads unless decedant (likely) had proerty.

Working on a probate case were 3 siblings are not getting along. Attorney is representing 2 clients, his client (wife) and her brother.

3rd brother wants to file his own petition.

In CA 3rd brother will need to file an Amended (Notice) of Petition to Administer Estate and represent himself (in pro-per) hopefully thru Legal-Aid.

Letter's of Administration (Capacity to sell) have been issued to his sister and he has a received a vacate order due tomorrow 11-17-12.

I will keep everyone informed.

In CA, the form required for the personal rep to perform in the transaction is called Letters Testamentary (with will) or Letters of Administration. Full Authority permits the sale of real property without going to court based on IAEA (Independent Administration of Estates Act) Full Authority permits the sale of real property without going to court, requiring only the noticing of heirs or beneficiaries and a 15 day opportunity for them to object. Also check the chain of title who the owner of record is. Good luck...
