Hi Rochelle,

We inherited a similar situation.  From what it sounds, you did not control his mode of employment, telling him he has to work certain hours, and the fact that he has another job is also indicative that he sounds like an independent contractor.  You need to contact a lawyer and confront this head on.  Our biggest problem was keeping the manager on board when we purchased the property, even though it felt as if he thought he was the owner.  He should have been relieved immediately.  

It was a learning experience for us.  All independent contractors are issued 1099s, and any full time employees are withheld taxes and have workers comp.  It is a bump in the road for you, but it's good that it happened early on so you can make the proper adjustments

 Thanks for the glimmer of hope.. he was issued 1099's for the  years he worked there.. I will be contacting an attorney tomorrow morning first thing..

Independent contractors like he insisted he is have to carry their own workers comp.

Make sure to send him his 1099 at the end of the year.

Get an attorney to counsel you on this.  Show him your interactions with this guy that you documented in a staff file with all the above info.

Good luck.  I'm not an attorney so not sure if this guy can win with pre-existing medical problems.

 FYI.. he sued his last employer.. I learned this but he was already working at the complex.. was one of my big reasons for saying " if you cant carry the tile or paint, maybe this job isnt for you".. didnt want him doing something on my watch that he could come back at me for

a little background info here.. I inherited a 60 unit apartment complex..we had a bunch of problems that have since been fixed, I took over full management responsibilities, am loving my new role and moving forward. 

When I took over we had a full time handyman in place who was being paid $1,000 a week, had no real schedule and they did not carry workers comp on him. I spoke to him and told him we needed to put him on our payroll and take out taxes, and cover him under our workers comp. He didnt like the idea and said he would handle his own taxes at the end of the year. At that point they had him receiving paid holidays and  a weeks  vacation. 

however he pretty much operated like a sub contractor, we asked him to start work at 9 due to tenants sleeping and getting ready for work, he insisted he needed to work 7-3 because he had a second job at night and wanted to beat traffic. ok.. we had a couple problems with tenants complaining they would be woke up by him entering the apartment while they were still asleep and getting ready for work. I asked him to do things that didnt require him to go into any apartments before 9 am.. he did not comply.. then when we were getting ready to flip an apartment I sat down with him and asked him to make a list of materials with me he thought he would need so I would have all the materials on site when the apartment was vacant. we sat there, made a list and I said " ok great, how long do you think it will take to paint, put in new counters, and do any repairs needed?"  he told me " dont rush me I got a bad back and I need you to  bring all the paint, and tile up the stairs and leave it in the apartment I am not picking that stuff up"... I asked him what he did to his back he said he hurt it years ago and he had recently been working on a bunch of boats and tweeked his back last weekend at his other job.. ( which he freelanced cleaning and shrink wrapping boats on his own for private owners) .. I was stunned he asked me to bring up boxes of tile and 5 gallon buckets of paint.. I then told him if his back hurt and he cant do the work anymore maybe this isnt the job for him.. he told me he would be fine and worry about myself.. then I asked again how long he thought the apartment would take and told him I had someone wanting to sign a lease so it would need to be done in the next 2 weeks.. at that point he came over to me where I was sitting, grabbed the paper I had written all the materials on and crumbled it up and threw it at me and said " you dont give me deadlines and tell me when something needs to be done, I tell YOU when an apartment is ready and when you can lease it" and then he said " I'm tired of you micromanaging everything I do"  ( to say he was unhappy with me taking my new role as property manager serious would be an understatement).. I think he was more comfortable with his free reign that he had under the old lax management.. at that point I guess he thought he would " show me" and didnt show up to work for the next 5 days ( at which point I quickly called a REAL subcontractor and had him do the job , which he completed in 5 days, well before the 2 weeks he thought was a tight schedule).. and then I met him and gave him his last paycheck and told him we no longer needed his services.. so now here is my problem.. I got a voice mail message from Workers Comp telling me he has filed a claim against me.. ( he sued his last job too, found that out afterwards.. so my question.. he was not covered under workers comp.. he didnt follow our rules, he made his own hours, didnt follow any schedule, did what he wanted when he wanted.. but we gave him paid holidays and vacation days.. so can he sue me/ the apartments personally...

 1,000.00 a week at 45.00 hour = about 22 hours a week ... Works about 2.5 days a week?

 sorry I should clarify, he charges OTHER people $45 an hour, he charges me $25.. because I have hooked him up with soooo much work with other people but even at the $45 an hour that is still a great rate for other people and a fabulous rate for me...he works from 8 :30- 4:30 most days monday thru friday

@Nat C., unfortunately this seems to be all too common.  I recently paid a handyman in full for a job that he didn't even complete halfway... yes, this was a terrible idea.  He has since disappeared and left us in a really tough spot.

@Jay Hinrichs, I like your system.  My experience with tradespeople in year one has really changed how I evaluate a deal.  While I may be able to get something done for x amount, it has not been worth the headache, risk and lost time/money to do so.  I would much rather pay reputable contractors and subs a "premium" in order to have a job well done.

 nope he called me at almost midnight to ask ask for an advance eon a job he hadn't even started..wierd.. I was guessing he was partying and ran out of money for drugs.. so I told him dont bother showing up Monday.. BUT since then I have hired a friend of my brother in laws.. I am posting for all of my fellow landlords/ and real estate investors in the Baltimore area.. I have found the BEST contractor and would be willing to share his info after  January 1st.. the reason I am waiting is he is currently working at our apartments, and was scheduled to  only do my kitchen, but when he was done I saw what a fabulous job he did, that I had him  redo my family room, and he is currently working on my basement, and will start my bathroom next week.  My husband asked me why the sudden urge to redo half of the house.. my reply " this guy is good, charges a great price and I am getting all my stuff done before he gets super busy".. he has been  doing this kind of work for about 5 years now on his own, and for 0 years with Champion remodeling and is busy ,but he has that golden tri facta we as landlords/ and investors are all looking for, honest, sober, great work, and a great price..I am almost reluctant to give his number out due to purchasing some investment properties in the spring and I will need him, but will let him know in advance when I need him back..if you would be interested in his information let me know and I will send it out after the first of the year..  an on the flip side. do you " hide" your really good contractors from people so you dont loose them? am i crazy to give out this guys number? I feel like I have the Golden Willy Wonka ticket with him??

He's correct, I don't trust any contractor in South Florida.

 I once had a guy who was scheduled to start a job the next week call me at  11 pm on a Saturday night to ask if he could get a front of $300  and in return  I could hold his tools till he started the job.. ummm no and dont bother showing up on Monday either..

Post: automatic lease renewal question???

Question.. I have a tenant who just gave me notice .. Her automatic lease renewal started today on November 1st..she gave me notice 2 weeks ago.. we sent out letters 2 months ago asking if she was staying and she didnt return the paperwork.. she said she just found a great house to rent and she doesnt want to pass it up..I was told we should have her sub lease the apartment if she wants out of the lease..we are at 100% capacity and dont have trouble finding good quality tenants so should I let her out of the lease? or if she leaves would 
I take her to court for the whole 12 months lease since it literally just renewed today? my question is are automatic renewals solid??? if you read my back log you will see im new at this so be kind please.. this is an honest question? I dont want to be a jerk but she had mentioned if i dont let her out of the lease i can keep her deposit and she will just move anyway.. I said " well then we will see you in court" but wondering if the automatic renewal holds up?

With argumentative tenants, I learned to only deal with them in writing.  I would not answer their calls, and I'd pop off a quick email or text only if it was required, like to schedule a repair.  I completely ignored calls or texts that were rambling weird complaints that could be ignored.  I'd make a note in their file, though.  And was glad to see them move out :-)

For instance, I routinely ignored angry voicemails from tenants about how they could hear other tenants having loud sex.  LOL.  Um nope, not knocking on someone's door to discuss their loud sex.

And I only had 25 units.  I bet you could tell some stories!

Anyway, you're in the frying pan right now, but you'll learn.

 @SueKelly  thank you so much for the vote of confidence.. so many people replied " hire someone".. yea thats not me.. I am not an expert by any means but pretty sure we all started out winging it..I can say I am proud of myself.. we went from 13 vacancies, 1 squatter, 2 non payers out of 60 units.. ( the 13 units were vacant for over 6 months before i took over) we are now at 99% capacity ( i have 1 stinking studio i havent rented and it bugs me) i have doubled the rent roll yes you read that correctly doubled!!!  i truly started this last august.. just recently joined this group.. our annual rent roll  WAS $300,000 a year it is now $624,000.. how did i do that? i upped the rent on the vacancies that I filled.. and the ones that have turned since then I upped.. collected $12,000 in back rent from the 2 who werent paying ( however the one guy fell behind again in february and i evicted him) I project that by June 2016 my rent roll will be right around $700,000  tell me how a rookie did that?? so no Im not quitting.. oh and I now have a wait list a mile ling and am looking to start buying single family home right next to me and fill em

 The day after he said he was going to call the police I was on site showing an apartment to a prospective tenant and I see the fire department and 3 fire trucks pulling up to my building.. he had called the fire department and said he smelled gas in the apartment..the fire department came in and said there is nothing there that is gas since our stoves are electric.. as the fire department was leaving i told them our furnace have a pilot light.. they went back in and check it and it was out.,. then Baltimore gas and electric showed up and said their gas leak detector detected small amount of gas leaking.. it was coming from a cracked head on the furnace.. so it was old and need of replacement.. so we decided to replace it completely  however I need to mention I have brought my mother in law on board to do the book keeping duties and she is on site 2 days a week to let the exterminator in and do paperwork.. she was bombarded by this tenant who was threatening to call the police due to no ac and without consulting me she hired someone who was willing to install a unit in 2 days time instead of a week and instead of spending $3,500 for a new unit she spend $7,000.. this is a huge problem for me as I have a policy of no work or repairs done over $500 without my consent.. so he got a new $7,000 unit.. and I have taken the checkbook from my mother in law..
