@Joe Splitrock  You are right... bad example.  I actually agree with you; there is no reason to tolerate incompetence, and in any litigation that would be taken into account.  I, for one, would not pursue a commission if the client was so dissatisfied  - it is just bad business.   A good agent succeeds only through repeat business and referrals- or as you say, superior service.  I just wanted to point out that there are legal grounds for an implied agency agreement in real estate.

@Joe Splitrock  There is a fine line when it comes to what constitutes procuring cause.  Now, if a Realtor shows you a house and in effect started the chain of events that got you to buy that house, litigation may side with that agent.  @Sam Lin is right, an ethical agent will ask if you are working with someone else- not only because it is the right thing to do but also because nobody wants to end up in litigation.  When an agent shows you a house, even if there is no agreement signed, there is an assumption that a commission will be paid if you buy that house... in some cases this is an implied agreement.  Almost akin to getting in a taxi cab and telling them where you want to go.

When you say that you started working with her, was there an agreement signed?  Even if there is not she can have a claim to the commission if she started the chain of events that led to the decision to buy.  This is what we call a precuring cause.  She would be the precuring cause if her efforts led you to enter into a contract for the property.  In that case she has a claim.

I also live near Cocoa Beach and have looked into investing there.  The benefit of Cocoa Beach is that there is a ton of marketing for the town- especially with Ron Jon Surf Shop there.  That makes the name sound familiar to Florida visitors who fall in love with FL and want to invest here.  Do not underestimate the value of that "brand" recognition.  My sister, who lives in NJ, came to visit us recently and insisted on staying in Cocoa Beach- she had only seen the billboards all over FL!  For vacation rentals a property there would do better than in other lesser known areas.  That being said, Cocoa Beach is different than other beaches in the Space Coast in that it draws a young crowd.  There are always events going on at the beach- tents, radio stations, volleyball tournaments... and surfing, of course.  I live near Satellite beach which is a lot quieter.  Very different in that it is not a tourist place.  No hotels, vendors, or any events going on... but great for a family looking for a quiet beach setting only an hour away from the Orlando attractions.  Indialantic may be a little of both- not as touristy as Cocoa Beach or as isolated as Satellite.  @Scott Schuetz is the expert in that area!
