I also have a rental propertythat I own with no mortgage or loans. I'm wanting to borrow against my rental to purchase a second rental. My mortgage broker has advised me to put my residence and my rental property into an LLC and then go for a commercial loan.

I'm seeing that this would be easier but I had a quick look on the net and the interest rates seem so high! Is there any way around that?

Thank you for your post. It's my understanding that in Iowa is only the FED that requires a server.

I also believe in Iowa an attorney is allowed to small claims court. Also, there are eviction attorneys in Iowa so in assuming they must be allowed to represent their clients.

Des Moines, Iowa.

I served a 3 day notice, personally and signed by a ternary, and on the third day they said they had part of the rent and would have the rest the following week. Nice try. I declined the partial payment. I had one of the tenants, sign a 7 day notice on the off chance they would pay.

Today is the last day to pay and I haven't heard from them, except for a text message from a relative of theirs saying that I needed to let them pay late or they would drag out the eviction process. I ignored that.

My plan is to file for an FED tomorrow morning. I have a few questions first.

Do I have to contact them today or do I just wait to see if they contact me?

It's my understanding that I go to the civil court on 5th Street and file. The Sheriff has an office there too for service. Is that the best way or should I use another process server? The IA REIA has a recommended server on their website. Any reason not to use the Sheriff?

Am I correct in that this is just to get possession. That I would later file a small claims for rent, late fees and any damages?

If I have an attorney at the hearing can I include the coat of that in what they owe me?

I know where the one tenant works. I'm thinking with this I can get a garnishment if I have to. Can I?

Thanks for all your responses. 

I contacted Cozy and they replied promptly. They did advise that I could end the lease. If the tenants then bring themselves current I can extend the lease.

I looked up Linn County Sheriff's site. Good info. Thanks. The Landlord's of Linn County require a password though.

I do have an additional question. How do I serve them? I've read numerous ways ate acceptable.

Personally serving and having them sign an acknowledgement. Posting a notice at the property which also requires notices sent by revaluation and certified mail. Using a server.

What are my options?

Here we go! First month's rent rent up front. Second month's rent paid on time. Third month an email to say it would be late. Paid four days late but they didn't pay the late fees. Fourth month was due yesterday. Not paid and no contact from them.

I want to serve them with a 3 day notice to quit or cure. I've found examples online but have a couple of questions.

1. Do I need to cite the legislation code that I'm using?

2. Can I include late fees?

3. I use Cozy for online payments. If they make a partial payment online will it negate the notice to quit?
