Post: 1031 disclosure or not?

As far as I know, it is the law that you disclose. That would be federal law, so it isn't going to matter what state you are in.

Actually, it is not a disclosure for the seller or buyer, it is a declaration of intent for the IRS.

I've never had it affect a purchase or sale, either one.

I don't accept Section 8, so I am just judging from the "housing wanted" ads. It looks to me like section 8 is now paying less than market rent plus insisting that utilities be included for that low rent.

The local Section 8 office makes it clear that landlords are "the enemy" and landlords abuse and cheat their darling and deserving clients. They refuse to be called Section 8 and have their clients trained to deny that they are receiving Section 8.

Who needs it? Not me.

All the Section 8 applicants I have had have been welfare cheats. Huge incomes, new cars, multiple horses. I also do not need tenants who are skilled at gaming the system. Especially not those given a free lawyer to fight me in court.

The local Safeway and the Walmart have flooring that looks just like Allure, but feels thicker. (Yes, that was me down on my hands and knees in the produce section of Safeway, feeling the flooring)

Whatever they are using, I want some of it, but haven't had any luck with finding out what it is or how to get it.

I'm having good luck with the Allure in rentals.

I just redid a kitchen floor that had a huge hole in the subfloor and could not match the thickness of the subfloor exactly. So the floor was coated with leveling compound and it came out beautiful.

Maybe the leveling compound would be the answer to an uneven floor, before installing the Allure?

I just did a smallish bathroom in tile and yikes! It was almost $500. Leveling compound, backer board, mortar, tiles, sealer, grout, and on and on.

The Allure, I can install myself.

I've got to tell you, I am done with carpet. I swear I am not buying any more carpet for the tenants to destroy.

Landlord will give you notice before he comes into your individual room. He doesn't have to give notice to come into the common areas (living room, kitchen, gardens)

It would be more polite for him to do so, but he doesn't have to.

You weren't really expecting privacy in a house shared with 6 people?

"Smoking is not permitted inside the buildings or on the premises."

That's all you need.

Elsewhere in the agreement, it states that the tenant is liable for the costs to clean up any smoke damage or burns from any source, including incense, candles, smoking, or fireplace.

I only do month to month, so if they get caught smoking, I give them notice to vacate.

If a very good tenant has a good reason and makes arrangements in advance, I will occasionally not charge the late fee. I appreciate good communication and rewarding it reinforces it.

I post the pay or quit on the first day the law allows and start evictions on the first day I am permitted to do so. Just the pay or quit has always done the job for me.

However, no tenant gets more than 2 pay or quits. I use month to month and if a tenant has to be bullied to get him to pay, I kick him out and replace him with someone who can afford the rent.

If I could get a better place for a better deal, I would simply rent that. There is no reason to even say anything to the in-laws, except for "no thanks, I found something else to rent"

I can predict hard feelings if you try to negotiate and I suspect they will be difficult to deal with, in any case. So just bypass problems before they even start.

Whether or not you can cash flow depends upon how good a negotiator and how good a promoter you are.

Things to consider:

In Hawaii, real estate is expensive, utilities are expensive, HOA and condo fees are really expensive, maintenance is expensive, and insurance is expensive.

Hawaii charges a very high tax on vacation rentals.

The locations where you can legally rent out a building as a vacation rental are very limited and the state is cracking down on the people who rent out their place short term in an area what is not zoned for it.

Full time residents in residential areas do not like to have a vacation house on their block and they have the law do something about it. So don't just hope nobody will turn you in.

Seriously. Go find something else to buy. It's not worth getting into an expensive lawsuit over.
