I've already contacted 2 custodians on this matter and one says it's ok and the other says contact a CPA or lawyer. I've reached out to both but figured I'd ask here too.  I know it's a confusing subject so I'll try to illustrate it below. We haven't done this yet, just trying to make sure we don't do anything that is considered a prohibited transaction.

A) Brother's SDIRA and Sister's SDIRA buy rental property A together. This is not a prohibited transaction. 

B) Brother's SDIRA and Brother-in-Laws (Sister's husband) SDIRA buy rental property B together. This is not a prohibited transaction.

I know that we can do either A or B alone and it would be ok. But the question is can we do both A and B as long as the husband and wife's SDIRA's are not involved in the same property together with the brother's SDIRA?

The latest one I did was if they decide to exit before the agreed upon hold plan then they get their original investment back minus any rent's they have received and lose any equity the property has gained. Pretty simple, stay for the term of the agreement or lose your gains......

@Gerardo Tapia I use and recommend Hickman & Hickman. They are in New Braunfels and know real estate very well.

@Eric B. You need to contact the Justice of the Peace in the county that your property is located. Every county has their own rules.

@George Vigil Your non-recourse loans are going to be based off of the DSCR of your rental properties so you might want to calculate that as well. Not sure about Cibolo/Shertz, I mainly invest in New Braunfels because I moved here in 1982 and it has never stopped growing yet. I use a local property management company to manage my properties.

@George Vigil Don't let UDFI scare you. It's not that big of a tax hit. I see a lot of people trashing SDIRA real estate investments because of UBIT/UDFI and they obviously aren't doing it themselves or they would know that it IS NOT a very big tax hit. Listen to @Brian Eastman. He's one of the ones on this forum that knows what he is talking about. NASB is the best bank out there when it comes to non-recourse loans for your SDIRA. Good luck!

@Dylan Barnard Call Jason Zook at North American Savings Bank for the best non-recourse rates. I've been using them for quite awhile and no one has been able to beat their rates.

@Lance Marshall I love buying properties in my SDIRA LLC because I will never pay tax on capital gains and my tenants will pay the tax on any distributions I take in the future.
