I will ditto what @Paul Dashevsky is saying. Never give more than 10% upfront and make sure that the progress payments are spelled out clearly.  Try and get as many details as possible so it's no confusion.

@Paul Wolfson you should definitely call or walk in to the planning department for this question. I would want to hear the response from the horses mouth and then document it. I use this form when I have general ADU questions:
