I'd negotiate a lower price with no commission. Then you don't have to pay income tax or break off a (large) piece for your broker. The seller should ONLY care about his net, not where the money is going.

Okay, so he is entitled to the $100k in equity. The fact that she doesn't "want him to get a dime" doesn't matter. She is entitled to add certain fees, etc to the foreclosure judgement and she would get paid first if she is in first position. The owner's lawyer is correct about the auction. Your friend's mom would be made whole through the auction. Only other way out of it is if the lender and owner agree to a buyout. But if there is 100k in equity, he'd be foolish to agree. Best bet is to get him to sell it at market price.

Your friends thought about the owner not making any money on it.... that's called "stealing." Any "creative" solutions are fraud.

Both are important, but it depends on your goals... Going to use the cash for retirement/cover living expenses? Cashflow
