Vickie Bruce You are being way too easy. Your tenants shouldn't be allowed to bring another person in unless a minor family member and shouldn't be allowed to have pets if that's what you want as your policy. Don't have wishy washy leases. Pets IF approved; another person, etc. Should say only residents are on the lease and No Pets. My lease says pets = forfeiture of xxx of security deposit and move for eviction. Period.

@Ron S.Thank you.  Yes I am purchasing a home from a seller who didn't mention anything actually.  Once we pulled title, this second was on it.  He provided a 1099C for the second but I am still not clear how he got the 1099C.  The first was cancelled in 2008 or so.  Both original mortgages were from the same company.  Both were sold a couple of times.  The second ended up with Caliber who issued the 1099C in 2011.  The seller said he filed taxes that year with it and assumed it meant the debt was cancelled and the mortgage released.  Fast forward to now and it wasn't released.  It is for $32k.  Hope that helps but I will tell him about CFPB because he's getting no response yay or nay from Caliber.

@Ron S. Thank you for your reply.  Should the seller be attempting to engage the title company from the initial sale?  I thought that he may be able to get them involved but wasn't sure given the nature of the 1099C.  I think it was as a result of the bankruptcy several years prior.  I am assuming the second got extinguished somehow or forgiven since the guy wasn't paying the first.

@Domenic Tankersley Thanks for your reply.  I am not certain what the circumstances are surrounding the loan.  The seller took out two loans in 2006.  The loans were sold several times, first from CIT to Optimum to AmeriLoan I think.  The first loan ($128k) was satisfied by AmeriLoan in or around 2010.  The seller filed bankruptcy sometime in 2007 or 2008.  The second CIT loan ($32k) was ultimately sold through various parties and in 2011, seller received a 1099C from Vericrest financial.  He already filed taxes relating to it.  When we call the number on the 1099C, it goes to Caliber.  We have been stalled at that point because not one person at Caliber picks up the phone.  We have tried every angle.  Several phone numbers, etc.  The seller has emailed them no less than 20 times.  We are simply totally stalled.  We are trying to get this lien removed so that I can purchase the house.

Any help would be appreciated.

@Buddy Holmes I can't even get passed the phone prompts.  Ridiculous.

@Will Gaston I would cite privacy issues unless the student gives permission.  Why not come up with a one designated person rule?  Either the student or one parent.  I know that I have a kid in college and I wasn't allowed to get any information unless she signed a FERPA form.  I am not sure if there is a companion form/law for property management, but I am sure there are general privacy laws.

No it was a 5 year fixed rate amortized over 30.  It adjusts after 5 years or you pay it off or refinance it.

@Jacob Murphy I don't and they never asked either.  Totally based on the property.
