So we have a PITA tenant...I just have to laugh at the latest email Monday, "We are not able to take a shower upstairs. The faucet is broken...we just take a shower downstairs which is not as accessible...the shower head does not stay so it takes us longer..." Turns out it's just a loose screw in the upstairs shower handle. And the "issue" with the downstairs shower is that the water pressure is lower, shower head points down not out, but its a handheld style so we tell her to hold it to get the water where she wants, "well then I have to wash my hair with two hands".

@James Syed 735 Ill. Com. Stat. § § 5/9-201 to 321 & 765 Ill. Comp. Stat. § § 705/0.01 to 742/30 is all of the Illinois statue/law on landlord tenant that I am aware of, and none of that law addresses this.

If your lawyer said you couldn't recover those fees in your one special case, perhaps it was because your lease wasn't written specifying how money paid would be allocated, or perhaps your lawyer knew that the judge you were going to be in front of would just throw out any claims for money owed for anything other than rent, but based on that one case you experienced, I wouldn't deduct that in Illinois it's not possible to recover those fees.

@James Syed Interesting, I have read 735 Ill. Com. Stat. § § 5/9-201 to 321 & 765 Ill. Comp. Stat. § § 705/0.01 to 742/30 and didn't see anything in there about not being able to deduct fees, etc. from rent payment, what am I missing?

@Shannon Gauthier when I consulted an attorney for a problem I had, she said to send two copies of a notice to the tenant, one via regular mail, the other with the certified return receipt where you get that green card back if they signed for it.

@James Syed what is your source for saying"in Illinois, you can’t deduct any late OR NSF fees from rent payment."?

I assume the house is in Ohio, I am in the Chicago area, same weather, those reasons sounds really bizarramgo.

You should prorate the rent if the place was uninhabitable and they had to leave, but there renters insurance should put them up, if their insurance covers unhabitability for this reason. If it doesn't, that is on them.

Uninhabitable since Dec 17th is a really, really  long time...it's still not fixed??? What does your lease say about uninhabitability for this long?, anything? What have they been telling you all this time??

Furnace stopped working, got repaired, stopped working about 3 hours later, hvac guy came out again, so far so good since then. Glad to get someone out so we didn't have to deal with busted pipes, the water main and furnace in this house are in the garage
