@Agi Anderson Unclear what the reason was.

@Russell Brazil my closing attorney doesn't litigate, and he offered to file the lis pendens at no cost (except the $53 filing fee from the town) so I know that his advice wasn't predicated on receiving billable hours. Whether or not we will win for specific performance is another story, but as I mentioned above the lis pendens will hopefully prevent him from selling it to someone else.

Thanks @Charlie Fitzgerald. Yes and I feel terrible for the listing agent because she worked her butt off to help this guy for two years, and is getting screwed. The broker is likely also going to be filing a lis pendens. The seller's attorney was informed that he is not longer being retained by her client.

@Wayne Brooks You may be correct. However, our intention of the suit is for him to perform his obligations under the contract. Hopefully when we file the lawsuit, or preferably before, the seller will understand that if he does not perform he will not be able to sell it to someone else* without clearing the lis pendens with us. Unfortunately, for the seller if we file the lis pendens and he does not perform he will likely be foreclosed on - I hope for everyone that does not happen

*The listing agent told me that a week ago "someone" called her and wanted her to substitute their name as the buyer. The listing agent of course told him no, and the listing agent believes the person that called her to substitute the name is a friend of the seller and they are trying to work out a deal, because now it's an approved short sale.

@Gene D. Good thought, and that would be my first choice but since it's a short sale we are not allowed to give anything to the seller. Also, we are not going to be breaking the bank to sue this guy, and I doubt he will pay for an attorney to represent him.

@Brett Goldsmith We were supposed to close in the next week. From what the listing agent told me he is either A) pissed because how much he paid and now what we are buying it for, and/or B) he might be trying to sell it to a friend. Both the listing agent and his attorney explained to him that he's under contract with us and the bank has not approved anyone else.

We have an approved short sale and the listing agent just informed us that he will not sell it anymore. Our contract is valid, enforceable and past any contingency periods. Our attorney advised us to file a lawsuit and a Lis Pendens on the property, which we will be doing. 

Has this happened to anyone else here? Any other advice/thoughts?

  • Side notes:
  • Our contract includes a provision for bank approval contingency.
  • He owes about three-times what the property is worth and I don't believe he has made a mortgage payment in approximately three years.

Place: Anna Liffey's (a great Irish pub) at 1494 Old Post Rd, Fairfield CT 06824 [NOTE: We are in the back room http://annaliffeys.com]

Time: 

  • 7PM - 7:45 mingle. 
  • At 7:45pm everyone has a chance to introduce themselves and this is a great time to tell everyone about you and what you are looking for. (Many people come including: flippers, brokers, hard money lenders, wholesalers, investors, attorneys, insurance agents, and more.)


No Cost: It's FREE! Okay it's almost free - please buy a drink(s) from the bar. Remember the more you have, the more you'll enjoy it. Just kidding. If you're driving or don't want to drink there are food options and non-alcoholic drinks.

[Important Side Note]: There is a Happy Hour from 4pm - 7pm before the event starts. I think it's half-off most drinks ($3 craft beers).
