I have a property in an LLC for which I am the sole member. What is the best, most efficient and seamless way to convey the property to someone else in the event of my death?

I have a single property with two homes on it- I live in one and the other has consistently been rented for the past 6 years.  Their have been occasions when both houses were rented and I did not live in either. 

If I sell it and would like to do a 1031 exchange, is it within 1031 rules to live at the new property if I will also be renting a portion of the property out, similar to my current arrangement? 

Lastly, if I am able to live at the new property while planning to also rent a part out, would I be eligible for an 'owner occupied' mortgage rate if it is my primary residence?  Is their a huge disparity between owner occupied vs. investment property mortgage rate?

We just replaced a garbage disposal in a rental property after the current tenant called to tell us it was making a grinding sound.  When the plumber came to take a look he found a screw and nail lodged in the disposal.  The tenant has been in the house for just over three months and has used small screws and nails all over to secure different cords, including for appliances in the kitchen, so we feel confident the nail and screw came from him and not from an earlier tenant, only somehow getting lodged now.  

The disposal was 13 years old. We had never had an issue with it previously, but I have read that an average lifespan for them is 8-15 years.

Should we cover the expense of the disposal, ask the tenant to cover the expense, or split the amount given the age of the disposal?

I am interested in purchasing notes, however, have concerns about being able to accurately value the property attached to a given note- the collateral.  As a former real estate agent who has completed BPO's, I understand their limitations in valuing a property.  A BPO will not unearth unseen problems that may exist, such as termite damage, excessive interior damage caused by an occupant, etc.  How do you manage this issue?  Thanks so much!
