We have a home we're preparing to sell- it's essentially a flip that we've had for only a few months. We live in a state that generally requires a property disclosure, however, we would like to avoid it if possible and sell the home 'as is' and request all offers be accompanied with an 'as is' addendum. We've seen banks do this with REO properties in states that typically require a property disclosure. Has anyone else done this and, given that the banks do it with their reo's, can private sellers do the same?

We have a property we'd like to make available as a pocket listing.  How exactly does this work?  May we make the house known as available to purchase to multiple agents, rather than committing to one?  Our preference would be not to sign anything tethering us to a single agent, but have it be an open secret with realtors in the area that the house is available-

Any insights appreciated!

Thanks!  Is  refinance somehow different to the bank?  I remember when we did a refinance years ago with a home that was in an llc, we were required to take the home out of the llc for the refinance.  I think the bank indicated that returning it to an llc following the refinance could allow them to call the note-

Are you able to purchase a residential property with an LLC? I've heard some people change into an llc following purchase- Does it make a difference it it's a commercial property- are you able to purchase initially with an llc then? Thanks!

Our real estate agent mentioned to the appraiser (prior to the appraisal) that their was a backup offer 'well above asking'.  She also mentioned that there had been a number of offers that exceeded asking price.

She has mentioned this a few times to me now in an effort to show she did her part to make sure the property appraised, however, I feel it borders on unethical.  I thought the point of an appraisal was supposed to be completed by an independent, third party and she is muddying the waters by sharing information about other offers.  

As the buyer who requires financing, I appreciate that in certain respects it is in my best interest if it appraises at asking, but I would also like an accurate figure that is not influenced.

Is it customary or legitimate for a realtor to share information about other offers with the appraiser prior to appraisal?

We have a property under contract and just got word today that we can close this Monday.  If we don't close Monday, we'll have to pay for an extension for a rate lock.

An issue has arisen with the sq. ft.- the realtor (who represents both buyer and seller here), listed the home at over 15% above the actual square footage.  She took the sellers word on the size- they said it's what the house's size was reported at during the last appraisal, though she never confirmed it by viewing the appraisal.

We want to address the large disparity in sq. ft. prior to closing, but our realtor has indicated she's out of town until Saturday.  We told her via text we needed to speak today, but she is unresponsive...  Should the realtor have given us a head's up she would be out of town?  Any suggestion as to how to move forward?  Thanks!

We have a home under contract and just received the appraisal, which indicates the home is 400 sq. ft. smaller than listed on the mls.  This represents a 13% difference in size.  The inspector did not measure sq. ft., so this is the first we're learning of the discrepancy.  

We made our offer based on a home that we believed to be 400 sq. ft. larger and would like to negotiate the price/ask for a credit/something similar to make up for the misrepresentation.  The agent is representing us as well as the sellers.

What is the best way to move forward and negotiate due to the smaller sq. ft. and what is reasonable to ask for?
