@Heather O. Here is how I have my lease worded:

"Late fees are to be paid without demand. All payments will first be allocated to all other charges owed by the tenants before the remainder is allocated towards the owed rent."

I have never had an issue in court with anyone questioning the exact amount owed. I send my tenants a screenshot of my excel tabulation and it computes what they owe in bold Red. They are never surprised or question what they owe.

Well, I like it, but now I don't.

They are saying that we can not use there payment processing service, for "Investment companys" however, I'm trying to explain to them that we are not SELLING investments, we are simply collecting rent.

Considering that you do not have a concern with the number of dogs (no mention in your lease) and did not act immediately when they added two more dogs I assume you do not have a issue with the actual number of dogs. Depending on how long all the dogs have been present your tenant may have the right to file a complaint with your landlord tenant board demanding you install a proper fence. Timing is the issue.

As the landlord, because you allowed the dogs, you are responsible for insuring the fence is adequate to contain them. You are partially liable for the neighbours child being bitten. 

Best hope your tenant does not know her rights.

Start screening better.  Between this and your pit bulls post, a lot of things are getting by you.  I would recommend you start doing in home visits with perspective tenants.  Then you’ll catch all these problems before they become your problem.

Nothing to do with the breed of the dog. If you have an issue with more dogs I hope you have that noted in your lease agreement and not just on your application.
