I found a property online that has 2 weeks left to go to auction. So, I door knocked and the current occupant says the owner wasnt there but they have the realtors number. I call the realtor, with official record judgement in hand, ready to make an offer. Realtor says the judgment is not 89k as listed in public record judgement, its actually 190k, AND unless our offer is min 210k, (its worth 250k) WE will be responsible for paying the realtor fee...except for some reason realtor has never been inside the property due to tenants but he still scheduled us a showing in a couple days. Realtor also doesnt know anything about the tenant situation, doesnt even know if it IS a tenant, and doesnt know if they'll be staying or leaving in time for our speedy closing. Fine, whatever i say, i make a preoffer pass of 193k, and let realtor know he and i can just split the assignment fee 50/50 since im simply assigning to my end buyer whale for 199k, an easy 3k each for an hours' works. Realtor says yea i could be happy with that...But, then realtor calls me an hour later saying that payoff is exactly $196,101 PLUS commissions so i will need to rethink the offer.
Heres my thing: this just all seems shady to me.. How is the realtor already representing the property with all the payoff info etc yet the property doesnt go to auction for another 2 weeks? And if the realtor represents the seller, why doesnt he have any info at all including the inside photos or even who the current occupant is or what that situation is? Was the seller really going to pay your commission at 210k or is it that that's just the auction reserve min price and your commission wouldve been paid by the auction people? Can i put "193k or payoff, whichever is lesser" in the purchase price slot because i dont believe him on the payoff amount? Did I unnecessarily inviting the realtor into a deal that did not require his efforts in the first place had i gotten in contact with the owners directly?
I would ask the realtor outright if he's in contract with owner/show me the payoff statement but i dont want to offend him just in case this is all normal procedure in pre-auction deals. I would go directly to the seller but not sure how i'd do that since the current occupants only gave me the realtors info and not the direct owner. Any help would be appreciated, thanks guys!
