Post: Wholesaing a NC Open Probate Deal w/ Claims Against The Estate?

I have a deal I'm working in Guilford County, NC that seems like a homerun with a comp that is the exact same build that was renovated and sold for $150,000. However, the property in question is still in open probate with two power of attorneys. The deceased passed in 2017 and probate has been open ever since with extensions filed and the court has notified them to file and both POA's have missed the deadline but an annual for each year was filed to bring things current. In the will of the owner she made one POA(neighbor) the executor and sole heir to her real property(however she did state she revoked her POA but there isn't any record of it being revoked in the register of deeds). The issue is that there are over $65,000 worth of claims against the estate that were all pretty much medical related bills. There are also almost $3,800 in back taxes but my purchase contract states that all debts against the property will be deducted from the purchase price. Since the property doesn't have a mortgage, as stated by the executor/POA/sole heir(next door neighbor and friend of deceased), will there be an issue getting the property sold? I am not sure if there are any liens(from claims) attached to the property at this time but the executor keeps trying to get the advice of the other POA who is also the attorney over the estate of the deceased whose wife recently passed. This POA/attorney over the estate is hard to get a hold of, is in his early seventies, and isn't returning anyone's calls.

My goal was to contract the property around land value($13,000) but because of the taxes my offer was $20,000. The property is completely dilapidated because of water damage from a pipe burst probably a year ago which resulted in black mold in which the damage hasn't even been determined yet. I have a couple of buyers in mind already but I can't get a contract signed. It seems the executor/POA/sole heir is fearful but she doesn't want to deal with this headache anymore. But the property needs to be sold to satisfy the claims against the estate. The attorney for the estate/other POA wants the executor/POA/sole heir to list the property but nobody is going to pay what they think the property is worth($70,000) because of the condition it's in and a real estate agent is even going to waste their time. My fear is that there are liens against the property(claims) and we won't be able to get clear title. Can the property even be assigned since it's in open probate? Please give all the advice you can. Thanks for your response. I’m willing to spend on marketing and skip tracing as I now realize those are expenses I just have to go ahead and fork over. But cold calling..can I just use a few scripts that I’ve downloaded to contact my sellers or do I have to pay for something extra (when it comes to cold calling)? Do you have any advice on google voice, using my personal cell, etc? Any advice is appreciated, thanks...

 Google voice is a good way to start with one number because it's free. Although it may be difficult to get a local number. But definitely don't use your personal cell number to call. Take a look at a service called CallRail where you can get 10 numbers for I think $30/month. This service is typically used for bandit sign numbers because they aren't traceable. They also have an app that will allow you to make and receive calls from those numbers. Hope that helps.

Wholesaling Sub2 deals are extremely easy and really no different than a standard wholesale deal other than some existing financing is staying in place instead of someone coming and paying cash....

Regular P/S assignable contract that states property is being sold with existing financing in place as owner financing. An additional addendum is created(there are simple templates available publicly) disclosing the terms of the existing loans.

You find a buyer who will take your place in the transaction, charge them an assignment fee and complete an assignment contract with them just like you would a standard wholesale contract.

There are a million variations and things you could do with Sub2's which is one of the reasons why I love them. Good luck to ya, hopefully someone else also gave you some decent information.

Would you have a source for the correct SUB 2 contract to use and the appropriate assignment contract to use?

Nick, I have a perfect opportunity for one of these deals. I am very lost on it though, some people say it's very easy like you just use a purchase and sale agreement, other articles I've read, tell you to put all these clauses in the contract and extra stuff, and I've read other people to stay away from these kind of deals. I have no idea who to follow, but since you seem to know what you are doing, I'd appreciate any help you'd be willing to offer so I can get this deal done instead of letting go. I understand the whole concept, but I don't know what wording, or where to put the deal is subject to since I've never done one before, thanks and hope you can help.

 Were you able to get this deal done. If so, how? What steps did you take?

I am actually in the same situation. I have a seller who has tenants who are constantly not paying rent or is always late and she has a mortgage. I have a buyer for the property but they are only able to do Sub 2 because they are low on cash because they haven't sold their current flip. I have no clue of what contracts to use for how to structure this. I have a normal P&S agreement and assignment contract. I am NC as well. Could someone help, thanks.
