Reviving this thread... I decided to purse the Historical Tax Credit program. I just had Part 1 approved and am now working through Part 2 of 3.

Reviving this thread... I decided to purse the Historical Tax Credit program. I just had Part 1 approved and am now working through Part 2 of 3. 

Update: In May 2020, Governor Cuomo implemented the Renters Relief Plan. Under the new plan, renters can use their security deposit to pay rent. The deposit needs to be paid back within 90 days, which isn't much help if your tenant is leaving in 30. I can't seem to find the specific text pertaining to this new rule, but I'm sure there is some nuance about last month's rent. Has anyone else been able to find it?

While it's not legal, do you know if there is any actual recourse for Landlords? Or would we be essentially wasting our time trying to argue with the tenant on this? 

Is it legal for a Tenant to insist on using their security deposit in lieu of their final rent payment? Any insight on this would be great.
