I spoke to my lawyer about it and he told me that it is best to just let this run its course because legal fees add up quick. I could see hiring him if it were something that I was actually missing out on cashflow, but for bare land I don't really want the added expense.

Yes, I was awarded an order of ejectment twice. He appealed the first time, got a new court date. He couldn't make it to that hearing because he was "sick". Finally showed up the next week and received 10 more days per the judge. Went to the property with a court officer and he had paperwork that he had filed another appeal so we couldn't do anything. Appeal was denied and we were going to go pull him out, but he appealed to a higher court. Now I get to wait this out. Btw, not sure why it keeps adding undefined after your name.

Yes they do. The father drives the son to court every time too. Apparently the restraining order only applies to the parents house and property, not the parents themselves. Father is 85 years old, squatter is 48 years old.

Yes they have a good reason to stay away from him. I read the report online and he was arrested for being on his parents property (who live next door and supply him with electricity). Apparently they have a restraining order on him. This whole situation is a cluster and to be honest, if I were reading this as someone elses story I probably wouldn't believe it.

Its okay even if you did fault me. It is my decisions that led me to where I am now. I was just venting about it hoping someone would read this and recall it if they were in the same situation. I for one will not be doing it this way again.

I attempted to have this done but the health dept. and township keep bouncing it back and forth because then they are responsible for the man.

The construction office already fined his dad $2000 for the code violation. I followed up this morning and they have yet to pay the fine so he said other matters will be taken and he will let me know.

This is my first time dealing with anything of this nature and I took the advice of the police. It has obviously proven to be wrong but I cannot take back what is already done.

I have my demo permit and I have dumpsters sitting on the property. I am just waiting for a "go" to demo it. I work 70 hours a week its hard to find time to sit and wait for him to leave.

The man apparently lived there before I purchased the property. The previous owners had to have known because they are related. The squatters father lives next door and the extension cord runs from his house to the shed on my property. It is useless to unplug it because it will just end up plugged back in. Also, I did not immediately demo the shed because he has things in there that I do not want to be responsible for replacing. The police told me this man is nothing but a nuisance and has sued the police before. Therefore the only way they will remove him is by court order with a court officer present. I have tried to do this the legal way to protect myself and I seem to just be spinning wheels. Even the people in the county court know this man on a first name basis. Everyone wants to be protected when dealing with him because he has nothing but time to drag out court cases and lawsuits etc. I have no legal recourse on the sellers because I have no proof that they knew he was there.

My mistake, it was so long ago I forgot. He did try to initially claim rights to the land but gave up on that cause right off the bat. He now has no agenda. I confronted him with the question in court about what he was hoping to get out of all of this and he couldn't answer it.

That is not the case here. I showed the cops my deed the first time I called them so its clear who the owner is. Plus the man isn't claiming any ownership to the property.

Update: As of today, the squatter is still in place. He has filed appeals in civil and law courts. He has filed an appeal to the appellate division, and today I learned that he has filed in superior court. I cannot help but think this man is getting legal advice from someone. He has also filed a $40k lawsuit against me for slander (since I called him a squatter, which is defamatory to his reputation) and he has also filed criminal harassment charges on me (because I bother him oh so much). Every time I feel like I am at the end I receive more paperwork with more court dates. This situation truly stinks. ATTN EVERYONE: PLEASE CHECK EVERY ORIFICE OF A PROPERTY BEFORE YOU SIGN PAPERS! I don't wish this situation on my worst enemy...
