Alexandra : Put your self in the sellers shoes . If I were the seller I might give you 10 days to get a Mortgage committment only . As far as Securing a Tenant that is pretty much on you . Again If I were the seller I would pass on it .

Have you at least gome to a bank to see where you stand for mortgage qualifications ?

I have found this to be true also even if your offer gets accepted it seems like Most banks take Forever to get their ducks in a row .

It seems to me your home owners policy should cover it . I hope you did NOT cancel it on your day of selling your old house . I never cancel any policy UNTIL I have no reason to go back to it .

I would say it was worth it just to get a clear title .

I let the Seller set the time if my schedule allows it .

Sounds like you really need a Competent RE attorney for this one .

Options Possible :

                        Ask the neighbor owning the land to sell the land to you at a Reasonable cost that the Garage sits on plus any Side yard variances if Applicable .

                       Move the Garage on to your deeded property . Pouring a slab for it might be the biggest cost incurred again making sure any side yard variences are noted . 

                      If you go with either option getting it resurveyed and recorded would be important .

                      What are you going to do with it when the time comes for you to resell the property ? 

                     OR : Simply walk away from the deal
