Post: Suing seller for not disclosing neighborhood nuisance (constant police sirens noise)

Hello - I bought a house in a Kansas City neighborhood in the summer.  The problem is that the it is located 1 street away from the major police car route, which I wasn't aware at the time.  When I visited the house during the day, it was very quiet.  But there's constant police car sirens noise every single day at night (throughout the night) that it's impacting my sleep and making me irritated and depressed.  I feel like the seller should have disclosed that as a material community nuisance.   Is there a way to sue the seller for not disclosing?   Any real estate attorney recommendation?  

Post: kitchen cabinet door repair cost out of security deposit

Hello - the tenant broke the kitchen cabinet door (the door came off completely).  The cabinet was less than 3yrs old.  I initially paid for repair but the repair job was not good at all - this was a lazy Susan cabinet door, the repairman tried to bond the two panels but there's so much gap between the two panels and paint has chipped, they're so ugly. Now I need to replace the door.  The repair was $210, the replacement is another $300. 

My question is how much can I deduct from the security deposit?

 No - I’m not charging higher rent because the prospect has a disabled parent.   The higher rent is due to a mother in law unit that’s included.

Would you rent to a prospective tenant who has a history of late payments?  From the landlord reference, I discovered that he made 3 late payments in the past year.  Each late payment was collected within 1-3 days (after 5-day grade period).  He will be moving in with a disabled parent, which would probably make it difficult to evict him if he’s late on payments.  I have another prospective tenant who will pay $200/mo lower rent but has been never late and also much better income to rent (6x) and employment with a very reputable firm.  

Would you rent to the first prospect for higher rent? My gut tells me not, I don’t want stress of chasing after a payment but want to know what others think.

Thanks everyone for your input.  I was so lost on what to do and really appreciate everyone's help.  

I pushed and got the $3,785 points refunded. As for rates, as everyone suggested, I took the  6.375% anyway.. not happy, but it was too late to find another lender (would have messed up the closing and the seller could have charged me for delaying) and even if I did, I would have locked in at a higher rate.

They also need to honor the rate lock if you signed a rate lock form. Without knowing all the info this seems little shady.


 I did.   And when we spoke the lender said he'd refund me the points in "cash" (not even wire) after closing, says he doesn't want to get the title company involved. So I'd still have to pay the points on closing and wait for the lender to give me bills... It's so close to the closing and honestly I don't know what I can do at this point.  I'd want to use a different lender but the mortgage rates have moved and the seller won't extend the closing date.

I signed "Uniform Residential Loan Application" on May 18, 2023, and locked in a 6% conventional loan mortgage rate with 0 points.  On Friday June 16, 2023, one business day before the closing date (closing is 6/20/2023), the lender sends me the final Closing Statement which says the rate is 6.375% and the point is $3,785.  The lender says the point is refundable but I need to pay on the closing day.  With regards to higher mortgage rate, apparently I had some issues.   The other items were also higher - the appraisal report and credit report fee were $300 higher than the original estimate.   During the whole month, the lender did not tell me the rate was changing and the fees were going to be higher.   Is this legal?  Is there anything I can do to make the lender honor the original rate and no points and pay lower appraisal/credit report fees?  If the point is really refundable, that will help, but this lender's practice is so shady and I'd rather not fund it upfront.

Hello - I am under contract to buy a new construction home.  It's supposed to close in 2 days but the builder is still doing the work, it seems like they are rushing to finish because of the pressure from the seller, but I feel like that's leading to very poor quality of work.  I had inspection done yesterday, and there are so many issues, in addition to cosmetic items I found on my own.  What's the best strategy to make sure the house is in the great condition when I take possession, i.e. how do I negotiate so that the seller/builder take care them all? 

Post: Bed bugs on the Walls/Ceiling

Hi - I started seeing bed bugs on the wall and ceiling in my living room a few weeks ago. Initially I didn't know what they were so I was just vacuuming them up.   A few days ago I finally used a bug identifier app and learned they were bed bugs.   I haven't seen a swarm yet, I just see one or two everyday.  I have a professional bed bug exterminators come in to assess the situation today and tomorrow. 

The question is, assuming I go for the heat treatment, will the entire house need to be treated?  I got 3 quotes - they're all expensive, but something in the line of $700-1400 for the first room ($1400 incl. kitchen/living/bath as well) then $300-400 for ea additional room.  So for the entire house I'm looking at $2,000 or more for 1,050 sqft house.   My priority is that I eliminate them completely before the situation gets worse, but I'm concerned that I spend all this money and it's not effective (bed bugs come back) and I'd have to do it again.  

Any recommendation?  And I should go for heat treatment, not chemical, correct?

There is no special conditions on the abatement?  I've seen some cities only grant abatements for non-investment properties and others grant them only for investors and some do it for anyone.  Some cities I guess feel that if you are renting out the property r a portion of it than they want their share of the pie too. 


 No - abatement is available for both owner-occupant and investor.
