@Don Chambers So let's look at this situation: Tenant gets court paperwork with your name on it, not your now ex partner . Tenant has no clue who you are, because tenant wasn't notified of the buy out/new ownership & how/when/where the rent should be paid (some tenants can be very creative )  as well as the other terms of the lease buy out, which will most likely be the reason why the tenant says they haven't paid because they don't know who you are & haven't been notified of any new ownership. Tenant can also say they paid your partner who is no longer the owner as the tenants defense in this situation and can delay your gaining possession of the property.

I would notify my tenants in writing of new ownership & keep a copy for myself in a situation like this, so there is no delay if an eviction should arise.

I don't see a problem as long as you give the tenant the appropriate notice in writing.

Well, I have rented to all of the above which is stated the original post. None of which I have had a problem with in regards to tearing up the property or paying on time if late, late fee is automatically included without a hassle .  The stripper has been with me for 3 almost 4 years and has used stripping as a stepping stone in her life and is now a licensed insurance agent in the area.

Personally, I haven't had to evict any of them.

I also stay on top of my paperwork for all of my tenants.

Hopefully you have some paperwork from the original owner which documents the sale/transfer of ownership which would explain why the eviction is filed under your name. Also, do you have documentation that the tenant has been notified of the new ownership & how /when/where the rents should be paid including late fees and things of that nature?

Get whatever documentation you can from the HOA. Take lots of pictures of the water damage in your unit, including ceilings/walls/flooring and any other damaged areas.

I would call my insurance company & explain it as "accidental flooding into your unit from the unit above"

I would consult with a RE Attorney or even the lender.

Recently I was in court for an eviction. As I was waiting for my case to be called at a case before my case, landlord brought 3 tenants/occupants to court for non payment/eviction. The judge asked the tenants did they owe this money, 2 of the 3 defendants said yes, the 3rd said no. The 2 who said yes, were in the process of filing bankruptcy. The judge advised the landlord that since they were under bankruptcy protection it's not much authority he has to evict. The 3rd who said no, was given another date to return for trial.

The landlord was advised to go to the bankruptcy court for information what would be the necessary steps the landlord needs to follow to evict the tenant. So I don't think there is much a landlord can do to prevent/protect themselves once the tenant has filed for bankruptcy.

Yes, I do that .  When I mail out the lease addendum I send a cover page with it requesting an appointment for a walk thru inspection & document my findings. 

During the inspection, I just take notes room by room & ask the tenant if they have any other problems that I may not see including electrical/plumbing issues. I check the walls, doors, door knobs, windows/screens everything.

Inspection would be a good idea even if it's  only for informational purposes.
