Post: Section 8 tenant not allowed to pay over fair market rent?

Hello,

I'm currently in the process of approving a section 8 applicant for one of my units. The case worker said the max rent they can pay is $1830/mo and not the full $2050 we advertised it for.... I talked to the tenant and they said they are 100% OK paying the difference but the case worker at section 8 said that she can't do that and it may cause the tenant to lose their benefits.

Has anyone dealt with this? Is this accurate information?

Thank you everyone for taking the time to provide more insight/advice. I have decided to send the notice to vacate for the unauthorized occupants in the unit. If you decide not to comply, is when you would have to contact an attorney to start th le eviction process... is that correct?

 Thanks for the input. I was thinking the same thing but definitely wanted to get other people's advice/insight as well. Would a 30 day notice be sufficient? Also, the tenant that left is in another state, not sure on the exact location - Would I just issue a notice to the subject property?

The unit needs quite a bit of work throughout as the seller hasn't done much to the property besides collect rent and fix issues as they arise.  That being said if I renovate the unit I can increase the rent up approx. $450/mo.

Your duplex story sounds very similar to mine! The lady in the second unit is a long term tenant and is clean and easy going (been there for 15 years or so). 

Hey BP, 

I'm in the process of closing on a Duplex in Los Angeles, CA and I was made aware days before closing that one of the tenants left in the middle of the night without giving notice. The lease agreement was month-to-month and was never renewed the caveat is that he had roommates move in some time between his tenancy there, which were never added on the lease agreement. My big questions are the following: 

1. What do I do with his security deposit? Should I give him the notice to make sure I'm protected on my end? 

2. The roommates keep asking if they can apply and renew a lease, What would you do in this scenario? 

A part of me is saying to vacate the premises so I can renovate and then get max rents in this market but another part of me is saying explore these prospects and still be able to increase rents a bit without carrying any reno cost.

Hey BP, 

Today I took the California state exam for salesperson , and passed ! I wanted to thank people who guided me along the way . Now I have a lot of questions . What brokerage to choose ? What should I start learning at home ? How is the interview process for a sales agent.? if anyone can share advice or tips , I would greatly appreciate it ! Thanks ????
