Scottsdale AZ Man Sues STR - Short Term Rental Owner
What set him off are the constant groups from Socal CA and unpredictable parties. It can cost $15,000 to $25,000 in legal fees alone if you get sued & complaints to AirBnb & VRBO can get you bounced out. So, if you are going to do things like this STR owner, you need to add that risk assessment/expense in with your STR expenses. Or, you can simply be respectful of the neighborhood, run your STR professionally and avoid these kinds of problems.

"Claiming that he has been putting up with noise, parking problems and other disturbances for three years, Rossi filed a lawsuit against the owners of the home, Matthew and Sarah Bassitt, who live in Bend, Oregon."
In return, Rossi got what he describes as a condescending letter from Matthew Bassitt.
“I can understand that you don’t like or appreciate short-term rentals,” the letter said. “However, you live in an area with no (home owners associations) or (covenants, conditions, and restrictions ), which is why homeowners like us are attracted to this area. Based on the additional homes we have seen recently become short-term rentals in our area, we do not believe this trend is going to stop.”
"The suit claims that by renting out the property as a short-term rental has unreasonably interfered with Rossi’s use and enjoyment of his home over an extended period of time – even to the point of preventing him and his wife from using their backyard and being awakened at 2 a.m."
Scottsdale passed two laws in 2021 designed to curb abuses by short-term renters.
The first ordinance requires each property’s emergency contact to respond in person to the site within one hour for emergencies if police have to respond for complaints about unruly gatherings.
The second ordinance sets fines at the maximum amounts allowed under state law.
"Rossi, who is seeking $75,000 and court costs, claims he has had to put up with party buses, raucous parties with topless women, foul language, noxious odors and thumping music."
Hopefully Mr. Rossi has some photo evidence of the raucous parties with topless women.
Risk management is an important part of self management, as well as keeping an eye on your guests in order to prevent neighbor-relations problems. Software and apps won't help.

Not that hard to run a responsible STR and treat your neighbors with respect. Some people think it's good business to cram every head they can find into their houses. Moderation in all things....

Lol. I was wondering if anyone would read the article and catch that. I'm sure the court will want proof. ;-)

Irresponsible owners like this are really hurting the STR market. Basically his response to the neighbor was 'tough luck, buddy.' This is exactly the attitude that neighbors take to their city councils to get STR restrictions passed. What an idiot. He's ultimately making it harder for everyone, himself included.

Exactly! All this owner would have had to do was go to the complainant and be nice, offer to take care of the problems...but no, he had to be a jerk. And there starts the problems that we all end up paying for.....
I’m sure this sucks for the homeowner. I wouldn’t mind.. wife and I’d be joining the topless party for sure!
Pretty much every suburb city in Phoenix has a 10 pm sound ordinance law. If people are being loud after that time you call the cops to handle it, after a couple of violations they start assessing fines to the owners.
@Bonnie Low agree entirely. No one should have to live next to this nuisance.
I think what ticked him off was the letter. He didn't file suit against the previous owners with all the parties just the guy who said hey your in an area with no HOA that allows STR. That owner had responded by adding noise aware and talking to him finally sending him "the letter". My guess is no STR no matter how quiet no STR is going to be successful in that house. And the former cop also made a point of saying you can call anytime your peace is disturbed not just after 10;30.
I would not want to live next to party central but my guess is the former cop may not be the best guy to live next to either.
