Troy F. Seller won't give up security deposits at sale

Assuming the leases clearly state a security deposit amount, the seller knows that the tenant will be wanting a refund when the lease ends (after closing) so should be an easy reminder that you need those funds credited to you at closing from them to refund to the tenant when needed.If the seller spent the tenants deposit, at least the credit to you at closing comes out of the sales proceeds (seller just nets that much less at closing) and assuming they have sufficient equity should not be a big deal.

Under New York law, landlords have 14 days after the tenant vacates the property to either return the full security deposit or provide an itemized statement indicating any deductions made from the deposit.If the landlord deducts any expenses from the security deposit, they must provide the tenant with an itemized list detailing each deduction and the corresponding cost.

@Mike Dumont so apart from some correspondence detailing how the funds would be handled, I would do the following.Colorado law gives the landlord 30 days to return a security deposit.

Just to clarify-Are you simplifying the amount to $19k for this explanation (But gave him an exact figure)....or did you put $19k on your line item to him but the receipts totaled $18,308 when he added them?

The security deposit would be applied to any monies owed and a letter would be sent within 30 days to the tenant.
